“14 DAYS WRONGFUL ARREST” “BENCH WARRANT ISSUED BY SUMTER COUNTY” “THE UNITED STATES OF AMERICA” “THE LAND OF THE FREE” 10-16-13 I was placed under arrest and wasn’t released until 10-29-13 after waking up in dorm B3-118 with anger in me. I told a Mrs. Officer Williams that if she did not get me someone to speak to in charge that I would “kill myself”. I also informed Mrs. Officer Williams the reason I was so upset is because I was in jail against my will and my Public Defender Mr. David Winheim had abandoned me on 10-17-13. This Desperate move I made in B3-118 would cause me to get assaulted by Mr. Officer Smalls and put in a straitjacket for 9 hours and placed on suicide watch where I met a nurse. She listened to my story and her big brother Mr. Eric Bryant a man with authority in the Sumter County Jail made one Phone Call around 2p.m on 10-29-13 and on the other end of the phone I heard “We made a huge mistake and we are releasing him”. Here is some concrete evidence of leaks in the Judicial System in Sumter County. 10-30-13 I received a signed document from my young public defender Mr. David Winheim stating in writing that I was in court and he sent me home to await another court date. This same Public Defender has thousands of other cases. Are there any other mistakes going on with citizen’s lives? THE CASE *9-25-12 I was arrested and booked in the Sumter County Jail (Incident No. 2012-10582) for 5 counts of Aggravated Assault, 1 count Criminal Damage 2nd Degree, and 1 count cruelty to children. I was bonded out 9-28-12 and was a free man until I’d have my fair day in court, which means I was innocent until proven guilty. I was awaiting court when a job opportunity came up and I deployed to Afghanistan for my third time and started out process on 02-21-13 and returned to the U.S on 07-14-13. 09-10-13 at 10a.m I had my first court date after my deployment. That morning when* I arrived at court I informed the personnel at the door in court my name (REGINALD GREEN) and I was running behind that morning. He asked if I had a lawyer. I then informed him that Mr. David Winheim was my public defender. At the time he was outside with a client so I stood and waited. Afterwards I approached Mr. Winheim and informed him who I was and that I was late for court. He then told me to sit tight and that he’d handle it. 10-16-13 I came in to contact with a Lee County officer who placed me under arrest because I had a bench warrant issued by Sumter County. I spent one night in an over booked Lee County jail where I slept on the floor in a plastic bed shaped container. I was inmate number 5 in 1 of the many 4 man prison type cells with locking door. *10-17-13 around 8:30a.m “Deputy Rutherford” of the “SUMTER COUNTY SHERRIFF OFFICE” arrived in Lee County signed a release form, grabbed my belongings, shackled my legs, and placed me in his car. I think to myself as my heart pounded this “BENCH WARRANT” thing is very serious” I only saw something like this on TV but I was the detainee I held my head in shame. As we drove Deputy Rutherford asked me “Mr. Green, Have you given your life to GOD”? I replied “Yes sir”. I am a GOD fearing man I think to myself but what if I was a MUSLIM? The pounding returned as we drove “NORTH ON U.S 19”. If I was indeed a MUSLIM my right would have been violated because you see we all don’t love the same GOD. I looked at a picture of a “PICTURE OF A COCASION MAN THAT LOOKED LIKE JESUS” hanging under his rear view mirror. I became angry because the man that detained me was the law but he didn’t know the law. This is my religion my “EVERYTHING I HAVE THAT’S FREE”. I knew I had a right to remain quiet as Deputy Rutherford turned up his “GOSPEL MUSIC” Now I felt worse so I remained silent.* I arrived at the “SUMTER COUNTY JAIL” around 9:45a.m I was booked and processed and placed under arrest for failure to appear in court on 9-10-13 by Miss Sgt. Sims. 10-17-13 I came in contact with Mr. David Winheim and informed him that I was in the Sumter County jail under arrest on a bench warrant issued by Sumter County for failure to appear in court. I explained in a frustrating manner that I had only been on the court calendar twice in 2013 since July and the dates where 9-10-13 and 10-1-13. On the date of 9-10-13 I informed Mr. David Winheim that he sent me home from court that day and I was 15 minutes late and he told me that he would handle it on the date of 9-10-13 my only day in court. Mr. David Winheim replied to me saying “I am not sure if I got you cleared through the judge that day”. The very next subject Mr. David Winheim asked me about taking a plea deal that the public defender was offering me “The first offender Act”. I told him that once he released me then we could discuss my case. Mr. Winheim replied that he needed to call the District Attorney and inform him of his mistake and that he was going to fax over the paperwork to have me released. I hung up and asked Mrs. Sims that was processing me was the phone call recorded and she said yes. 10-18-13 to 10-23-13 I was placed in dorm (B5) with 29 other inmates where I quickly learned that we were to share only 1 toilet and 2 showers that were severely unsanitary. This is one of the most disgusting things I’d ever had to go through in my life. In this dorm B5 we are locked in this dormitory like room 23 hours a day with one hour outside. Day after day I sent out what you call an “Inmate Request Form” that is for a prisoner to request 1 of 5 rights that a prisoner has while in the “Sumter County Jail”. Every “Inmate Request Form” I filled out stated that I needed to call my Public Defender Mr. David Winheim. Under remarks I stated that it’s on recording stating that he would have me released on 10-18-13. I did not get one reply from the “Inmate Request Form”. For days I could not take down the food because it tasted like water. I had no money on my books and could not call my family because I used my only phone call to call my public defender and never heard back from him. I drank from my hands for plenty of days at the sink because in the “Sumter County Jail” you get one 8.8oz Styrofoam cup when processed and after that you on your own. 10-24-13 - On the morning of 10-24-13 at breakfast I came in contact with Mrs. Officer Gothwin and complained to her how I thought the “Request Inmate Form” was a joke and how they are violating my rights by not responding. I asked Mrs. Gothwin could she get me a form and she replied “NAWL” and slammed the Iron door in my face. I was furious and at this point I am complaining to every Inmate in dorm B5 that my public defender abandoned me and I did not know what to do. I eventually got in a heated argument because one inmate jumped to his feet screaming that he had been in the “Sumter County Jail” for 6 months and he heard from his public defender once and he was told that he is awaiting court. I panicked when I heard this because I knew that I was unable to get bonded out. I came into contact with Mrs. Officer Brown during Rec. call and I informed her that I refuse to move until I saw someone in charge. She explained that I would have to wait and fill out an “Inmate Request Form”. I explained to her that I had sent out several of them and never got a reply. She explained that I could either go to the “Hole” are I would be charged with obstruction of an officer. I stood my ground and I said “You can just take me to the hole” since I can’t speak with someone in charge”. I was then place on “Admin Seg” In Dorm B3-118 for 7 days “The Hole”. I immediately knew when I stepped in Dorm B3 it was freezing cold so I immediately asked for a jacket. 10-25-13 to 10-28-13 Around 1:30a.m 10-25-13 my first day in “The Hole” I remember awaking out of my sleep in what is called a cold/sweat. I remembered sweating and shivering at the same time. I walked to the sink and toilet set-up in my 8x10 cell and filled the sink with hot water. I let my hands soak in the water until I could feel warmth enter my body. With the cold front that came through during these dates caused me to wake up in this same cold/sweat every time I lay down to sleep for the next 4 days. I repeated the hot water in the sink process to maybe have saved my life. I complained to an officer about how I though the cold Dorm B3 was a harsh punishment and the officer explained that it wasn’t a punishment. She explained that the A.C unit is broken on froze and had been that way for months. 10-29-13 I woke up in my 8X10 cell in the same cold/sweat and after using my only source of heat (hot water in a sink) to warm my body I went into a rage. I started kicking on the caged door in B3-118 until an officer ran in asking me what was wrong? I yelled through a hole in my 8x10 cage (where a tray can slide in to feed me like an animal) and told an Officer Williams that if she did not get someone in charge I would kill “Myself”. Minutes later I was approached by the SGT On duty around 5:30a.m and an Officer Smalls. The Sgt on duty asked me “What’s the hell going on” I explained almost in tears that I was wrongful arrested 13 day ago and on recording in the “Sumter County Jail” on 10-17-13 stating that he would send over the paperwork to have me released. I also said I refuse to go back in that cage until I talk to someone in charge. The Sgt on duty said I am taking you to the nurses’ station since you want to kill yourself. As we walked I was very rude because I thought now that I got someone in charge I better make it count so I said “First my public defender abandoned and lied to me, in Sumter County jail you all lock people in cages and freeze them to death, you all don’t know the law because you all have violated every right my ancestors was murdered over, and I degraded their pay and job description by this time Mr. Officer Smalls had become angry and he pushed me. I and Mr. Officer Smalls got in to a verbal confrontation that led to him choking me twice. While being choked both times by Mr. Officer Smalls I asked the Sgt both times “do you see this?” The Sgt on duty around 5:45a.m said to me I don’t see anything. I had only one witness the nurse that was present gazing in the back ground with her mouth dropped open. The Nurse came in and checked my blood pressure 4 times and I remember it reading 164/100 I was so angry from yelling at Mr. Smalls for putting his hands on me. I was then put in a straitjacket for the next 8 hours and Mr. Officer Eric Bryant made 1 phone call and I was released on a mistake by my Public defender David Winheim. 10-30-13 what gave me the push to put my story of what happened to me because I made a phone call the day of 10-30-13 to Mr. Sam Merritte who is in charge at the top of the chain-of-command at the “OFFICE OF THE CIRCUIT PUBLIC DEFENDER”? I EXPLAINED TO MR. SAM MERRIETTE THAT I HAD BEEN WRONGFULLY ARRESTED IN SUMTER COUNTY BECAUSE OF A MISTAKE MADE BY MY PUBLIC DEFENDER Mr. DAVID WINHEIM AND I CALLED HIM DAY 1 I WAS LOCKED UP AND INFORMED Mr. DAVID WINHEIM THAT I WAS IN COURT THE DAY OF THE ISSSUED BENCH WARRANT FOR FAILUR TO APPEAR ON 9-10-13. MR. SAM MERRITTE INFORMED ME THAT MR. DAVID WINHEIM IS A YOUNG ATTORNEY AND HE ARE GOING TO MAKE MISTAKES SOMETIME BECAUSE HE HUMAN. I ASKED MR. SAM MERRITTE SIR DO YOU MEAN MAKE MISTAKES WITH A U.S CITIZSAN LIFE. MR.SAM MERRITTE SAID YES BECAUSE HE IS A YOUNG LAWYER………THE LAND OF THE FREE…… If I indeed had a “BENCH WARRANT” on 9-10-13 then it’s funny I flew out of 2 major airports on 10-1-13 and I scanned in with my U.S passport both times. I also received a rental car in Oklahoma on 10-1-13. On 10-2-13 I flew back through those 2 major airports. On 10-10-13 I came in contact with APD incident No. 2013-10535 and still no signs of a bench warrant they say was from 9-30-13. I received all clear on a background check 10-15-13. Still no “BENCH WARRANT” Was the bench warrant foul play? 10-10-13 I received a text message from my ex-wife Chiquita Green stating that the District Attorney called her and asked her did she mind dropping the charges and since I never been in trouble before I would only get probation. She told me she agreed to drop the charges. He told her that she would not have to show up to court anymore because it was settled. *NOTE TO THE U.S: Only one huge problem I did not consent to any of that and I have not had my fair day in the “THE SUMTER COUNTY COURT” why are they discussing my personal case with my ACCUSER?*
