9 years IHL for defiling mentally disturbed girl Kasungu, September 24: A 38 year old man in Kasungu, who was arrested on suspicion that he defiled a 14 year old mentally disturbed girl but denied the charge after appearing before the Kasungu First Grade Magistrate Court on 25th August, has been sentenced to 108 months Imprisonment with Hard Labour (IHL) after being found guilty of the same charge. Police report accessed by Mana indicates that Jackson Nepiyala defiled the girl at a borehole on 16th August at around 04:00pm when the victim was drawing water. He was later arrested on the 22nd after the father of the victim reported the convict to Chatoloma Police upon seeing his daughter failing to walk properly. Medical examinations from Kaluluma Health Centre showed that the teenager was indeed defiled though Nepiyala refuted the claims in court. According to Kasungu police publicist Sub Inspector Edwin Kaunda, when Nepiyala reappeared before the court yesterday (22nd September) after being on remand for the past month, he was found guilty. “The state prosecutor Sergeant Francis Malenga paraded 3 witnesses and after full trial the court found the convict guilty of the charge. The prosecutor asked the court to mete out a stiffer sentence to deter other would be offenders. “His worship Damiano Banda conquered with the prosecutor and jailed Jackson to 9 years IHL,” explained Sub Inspector Kaunda. Nepiyala hails from Kapoloma Village in Traditional Authority (T/A) Chiwalo in Machinga.
