A child having equal time with both sides of its family IS in the best interest of the child. Its not that hard of a concept to understand. We advocate for a rebuttable presumption of 50/50 in all cases involving custody between two biological parents. A rebuttable presumption can be overcome. But the default starting point will be that both parents are fit and that a child deserves to the love and tie if both parents equally. This should be the default. It should be where we begin, just as we do with married parents. When a child is born, there is a natural presumption in place that both parents are loving fit parents. This presumption should carry over into any separation of the parents. We should not remove this presumption simply because one parent is now emotionally upset at the other and says otherwise, possibly desiring control and wishing to cause hurt to the other parent by denying a child access to a loving parent.
