BHRIs REPORT ON THE JUST HELD COURT CASE BETWEEN BIAFRAN AND NIGERIA ON THE 31ST OF MARCH 2014. FEEL FREE TO ASK QUESTIONS. Matthew Mbanaja Reports REPORT ON THE SUIT NO.FHC/OW/CS/192/2013,THE CASE BETWEEN THE FEDERAL GOVERNMENT OF NIGERIA AND BILIE HUMAN RIGHTS INITIATIVE REPRESENTING THE INDIGENOUS PEOPLE OF BIAFRA ON THE 31ST OF MARCH 2014 AT THE FEDERAL HIGH COURT OWERRI. M.M.Mbanaja By 8 am today being the 31st of March 2014,court 1 of the federal high court Owerri was filled to capacity by the indigenous people of Biafra and her team of lawyers led by Chief Debe Odumegwu Ojukwu, followed by Chief Bar. Nwachukwunta and Bar.O.O.Uwazie. The trial judge, Hon. Justice S.M.Shaibu entered the court in the usual court celebrity by 10 am. After the announcement of the case between Nigeria and Biafra and the introduction of the Biafran legal team by Chief Debe Odumegwu Ojukwu, the judge called on the defendants who were visibly absent at the court. In the absence of the defendants solicitors, Chief Debe Odumegwu Ojugwu, argued that the Biafran submission to put an expertise injunction on the ongoing national conference should be heard, Justice S.M.Shaibu asked the Biafran council the date that the motion was filed, he, Debe answered that it was dated on the 14th of March and filed same day. Debe argued further siting article 26 section 7 , subsection 2 and 3 of the federal court of Nigeria rule. At this juncture, two junior lawyers present at the court for different matter, tried to talk to themselves in apparent disagreement to Debe’s argument, the trial judge noticed the misdemeanor of this junior councils and threatened in a fury to walk them out of his court, however, Debe pleased to the Honorable judge to temper justice with mercy , on behalf of junior learned colleagues. The Honorable judge in his anger argued that the younger generation of lawyers in Nigeria are very insincere and not ready to learn the rudiments of jurisprudence from their senior colleagues, he went further to advise the airing lwayers to pay attention to the superior argument presented by theuitr senior colleague ,Debe Odumegwu Ojukwu so as to enrich their lacadestic legal brain for their betterment and that of the legal system in Nigeria. The case continued with the judge stopping Debe from further argument to save the Biafran legal team from further waste of legal time , having noticed a technical misrepresentation on the Biafran council, thus : the motion filed on the 14th of March 2014, praying for the court to put an expertise injunction on the ongoing national conference without taking the leave from the judge which technically failed the due process of the jurisprudence law. The judge in his humility and frustration of the wrong technicalities of the Biafran council, from passing a landmark judgment that could have stopped the fruitless ongoing confab, advised the Biafran legal team after due apology from Debe whom he asked to take a close date to follow the due legal process to re-submit same application.. The next date was adjourned to the 29th of April 2014. As usual the Biafran crowd moved to the secretariat at 92 wetheral road Owerri for a meeting where Debe in his usual characteristics addressed the mammoth crowd for their faith in what he believes is not a dream but a reality, he further mentioned the case at the confab where an emir from Adamawa openly pronounced sesession, meaning that , the topic is no longer a no go area and it is not only the Biafrans that want to go but also the North, it was however agreed at the meeting to issue a communique by the Bilie Human Rights Initiative to all Biafrans and the world that what we want and where we are going is Biafra and nothing less than that . The president of Bilie Human Rights Initiative in his address to the indigenous people of Biafra announced the remembrance ceremony being organized by the Akwa Ibom state government for the fallen heroes of Biafra during the three years of genocidal war against Biafra. All the indigenous people of Biafra across the Biafran provinces are expected to come to Ibom hall Uyo Akwa Ibom state on Sunday the 6th of April 2014 to show solidarity to our brothers in Akwa Ibom for being more Biafra than the Biafrans under the able leadership of the self confessed son of Biafra for life Dr Sam Apkabio, the executive governor of Akwa Ibom state.
