Bombshell: Federal judge suddenly green-lights lawsuit that could stop Obamacare in its tracks Oh dear. Oh dear, oh dear, oh dear. A federal judge on Tuesday refused to dismiss a case that could fatally cripple the Obamacare health insurance law. The Affordable Care Act forbids the federal government from enforcing the law in any state that opted out of setting up its own health care exchange, according to a group of small businesses whose lawsuit got a key hearing Monday in federal court. The Obama administration, according to their lawsuit, has ignored that language in the law, enforcing all of its provisions even in states where the federal government is operating the insurance marketplaces on the error-plagued Healthcare.gov website. Thirty-six states chose not to set up their exchanges, a move that effectively froze Washington, D.C. out of the authority to pay subsidies and other pot-sweeteners to convince citizens in those states to buy medical insurance. But the IRS overstepped its authority by paying subsidies in those states anyway, say the businesses and their lawyers. ~~~~~~~~~~~~~~~~~ This, folks, is what you get when a bunch of corrupt and incompetent Democratic legislators decide to concoct a piece of legislation Obamacare. A piece of legislation so horribly complex that those legislators decided to turn to the experts from the very industries whose pockets they were already deep inside of and then entrust those experts to craft the rest of the bill. A bill so poorly written, structured, and thought out that it was a trainwreck even before the ink used to print it was dry. And then those legislators passed the legislation without ever bothering to read it. Is this legal challenge to Obamacare enough to kill the whole ACA in its appalling debacle? Maybe, maybe not. It does show how stupidly and incompetently the whole thing was composed however. And for an attempt to screw around with an industry that comprises 17% (or so) of the American economy, such incompetence should be terrifying. And this is just the first of many legal challenges to the travesty that is otherwise known as the Affordable Care Act. The Hobby Lobby challenge (articles.washingtonpost/2013-09-20/national/42245333_1_obama-administration-mandate-u-s-supreme-court) is yet another that could kill critical pieces of the Act. And given that Obamacares creators were stupid enough not to address the severability issue, any single portion of the Act that gets invalidated takes the whole thing down. Mind you, given how poorly these clowns have run the set up of the Obamacare Exchanges, expecting the same bunch to have actually thought through the rest of Obamacare is indeed expecting too much. Fun times, eh?
