Car Accident Questions Part 2 (2)What is the verbal threshold? ( N.J. AICRA) The verbal threshold is a law that was passed in NJ and other states which provides essentially that you cannot bring a lawsuit for injuries sustained in a car accident unless you have a “serious injury”. NJ law defines “serious injury” as: 1) Death, 2) Dismemberment, 3) Loss of fetus, 4) Displaced fracture, 5) Significant scarring or disfigurement, and 6) Any other injury which is permanent in nature and can be proven by objective medical evidence such as an X-Ray, MRI, or CT Scan. If you are in a motor vehicle accident, it is important to seek medical treatment immediately for the sake of your health and to protect your rights. This is general advice that does not apply in all situations. If you have a specific question regarding this area of the law feel free to call me to discuss your specific situation.
