Carefully Select Your Employment Agencies Beware of Employment Traps Below is the advice from the Labour Department of the Hong Kong Special Administrative Region Government concerning the use of service from employment agencies: Only solicit the placement service of employment agencies licensed by the Labour Department. Check online for the list of employment agencies holding a valid licence: labour.gov.hk/eng/public/eaee/ea_list.pdf, or you can call 2852-3535 during office hours for enquiry. When you visit the employment agency, look for a valid licence displayed as such is required by law. Do NOT make any payment if the employment agency looks suspicious, or you are asked to conduct an interview outside the place of business of the employment agency. Report to the Labour Department through its 24-hour hotline 2-71-71-771 if you suspect any employment agency that is operating without a valid licence issued by the Labour Department. Always check the genuineness of job vacancy offered by employment agencies. If necessary, consult the relevant Consulate General of the destination country for the visa requirements if you are applying job vacancies overseas. Always request a receipt for any payment made to your employment agency. It is better if you deposit the payment directly at employment agency’s bank account so that you can have the payment record. Do NOT deposit the money into the personal account of, or pay by cash directly to, the staff of your employment agency, particularly if they refuse to provide you a receipt. Do NOT sign any documents which you do not fully understand or agree. About the fees charged by employment agencies – Under the law, employment agencies in Hong Kong can charge you no more than 10% of your first month’s salary as commission (i.e. prescribed commission). It is illegal for an employment agency to receive from you, in connection with obtaining employment for you, no matter for a job located in Hong Kong or overseas, any reward or payment in respect of expenses or otherwise, except the prescribed commission. Do NOT pay your employment agency by borrowing money from any loan company, even upon request of your employment agency. Report to the Labour Department through its 24-hour hotline 2-71-71-771 as soon as possible if you are overcharged or you are requested to take up loans by the employment agency. Under the laws of Hong Kong, prosecution has to be taken out within the statutory bar time of six (6) months. Report your case to the authorities immediately to avoid delay.
