Challenging Executive Power March 14, 2014 Ive outlined for you the various examples of Barack Obama unilaterally changing laws or simply failing to enforce laws on the books. This perversion of power has many questioning how this will effect the nature of our Constitutionally outlined institutions and the rule of law, which is why House Republicans are trying to do something about it. The House this week passed the “ENFORCE the Law Act.” The White House has already threatened to veto this legislation that would essentially speed up the process for members of Congress suing the Obama administration to faithfully enforce laws. But one has to wonder why Barack Obama would be so quick to say he would veto legislation such as this, when it wasnt long ago when he was warning of similar abuses of power. Does this statement ring any bells? “The biggest problems that were facing right now have to do with George Bush trying to bring more and more power into the executive branch and not go through Congress at all, and that’s what I intend to reverse when I’m President of the United States of America.” That was none other than Barack Obama warning of the dangers of the very things he is now doing as president. Or how about this one from then-Senator Obama: “No law can give Congress a backbone if it refuses to stand up as a co-equal branch as the Constitution made it.” The question becomes, what has changed since then? We are still a nation of laws, with a Constitution outlining the concept of co-equal branches of government and separation of powers. Republican Rep. Trey Gowdy of South Carolina took to the House floor this week and delivered a rousing speech on this issue. You can see the video here. He points to the hypocrisy of Obamas statements as a senator compared to his actions now as president. Gowdy makes an important point which is that the process matters, and it is non-partisan. The concept of an “imperial presidency” should trouble members of both parties, members of the other supposedly co-equal branches of government and the American people.
