Charles Pragnell TRUTH NEVER TRIUMPHS – ITS OPPONENTS JUST DIE OUT. SCIENCE ADVANCES ONE DEATH AT A TIME. “A new scientific truth does not triumph by convincing its opponents and making them see the light, but rather because its opponents eventually die, and a new generation grows up that is familiar with it”. T.S. Kuhn, The Structure of Scientific Revolutions). You may wish to ponder on two types of events which are becoming prevalent in Family Law Courts and Child Protection. Firstly, Family Court Custody Evaluators/Reporters and Guardians ad Litem can now determine that a parent can “subconsciously abuse their child”. How is that presented as a verifiable, credible, and rebuttable fact to a Court?. On what scientifically–based and peer-reviewed research is such an assertion made?. Or have Custody Evaluators/Reporters and Guardians ad Litem suddenly all been gifted with mind-reading?. Secondly, child protection workers are now removing babies and children from mothers on the grounds that they can predict that the mother will harm the child. Such child protection workers, obviously gifted with clairvoyancy, are removing such children in order to feed the adoption market. How can anyone be punished in law for what they might do in the future?. Imagine two police officers approaching you in the street and arresting you because they say that you will rob a bank at some time in the future?. Such charges would be thrown out of Court, and rightly so. No one can be tried nor can any action be taken against any person on the basis that they may commit a criminal act in the future. If it could be done, then why are the police not rounding up every paedophile in the country and bringing such charges against them as the likelihood of recidivism is the highest of any group in the criminal law. The assertions of Custody Evaluators/Reporters, Guardians ad Litem and child protection workers are so absurd and irrational that any of them making such claims such be referred immediately for psychiatric treatment for delusions and irrational behaviours. Or must we wait until they all die?.
