EMAIL NOW - : [email protected] > I support Bill 113 Draft 2 with No Onishi amendments There are various legislative ways address the problems resulting from the multinational biotech (chemical) companies imposition of its GMOs and associated pesticides. county legislation, Bill 113, is foremost geared to protect the property rights of non-gmo farmers and other property owners from unwanted pollen gene drift and pesticide drift, as well as protect our public property -- our public trust resources... starting with protection of the soil, the soil microbes, the beneficial insects. Indirectly we are also benefiting the health of our people and the environment generally. Other approaches include legislation geared to the consumer -- such as labeling, which is being attempted on both the federal and state levels. Likewise patent law plays a big role, and there have been attempts to reign in the patent laws to protect those whose property has been contaminated through no fault of their own. The problem is virtually all of the federal legislative efforts aimed at protecting those adversely affected by GMOs and associated pesticides have failed, and likewise the states have not been very successful at curbing the domination of these multinational predatory chemical companies (most of which moved from a focus on chemical warfare to biotech/chemical ag). Take for example the failed Patent Reform Act of 2005, which again failed in 2007 and 2009 (would have protected those who unintentionally violate GMO patent laws from broad liability - enhanced damages. a few states including Missouri, New York, and our state of Hawaii, have proposed but not succeeded in passing protective legislation. To date, to my knowledge, the successful efforts have been on the local level -- where the people are closest to their government. No wonder the biotech lobbyists take aim at eliminating county/local jurisdiction over any area that affects agriculture -- by way of gutting state home rule statute, or passing or extending right to farm laws to insulate them from lawsuits or any liability. SB 727 (gut county home rule) and SB509 (expand the right to farm law in attempt to insulate biotech ag practices) are on point. We can expect these to be revived in 2014. At the House Judiciary Committee hearing on SB727, the biotech reps and allies, explained they have succeeded in eliminating local jurisdiction over GMO issues in some 20+ states, and want to get this legislation passed in Hawaii. (The bill had already passed the Hawaii Senate with only one senator in opposition.) They explained that local governments interfere with their corporate policies. I testified that we on the island of Hawaii will not tolerate putting an ocean between the people and its first layer of government. Clearly if government on the federal or state level were being effective in regulating GMOs and associated pesticides, we would not need to pass county level laws. However that is certainly not the case. We must take a stand and pass Hawaii County Bill 113.
