I cant accept the excuse of mental instability in this case. There is too much evidence of planning. In the first 8 seconds or so of the video, there are too many actions that show the man with the bat taking precautions to find a victim that is alone. As you watch this, think what could you do to prevent someone else becoming a victim? At what point would you intervene if you were a witness? Once the attack is over, do you render aid, confront the aggressor, or call 911? If the aggressor drops the bat and walks away, what do you do? Everything is situational and no one answer will cover the situation, so this is just food for thought: Can a bat be reasonably used to inflict grievous injury or death? Does the aggressor have the opportunity and ability to inflict grievous injury or death? Has the aggressor shown manifest intent to inflict grievous injury or death or made an overtly aggressive act?
