In October, Cincinnati Council Member Charlie Winburn suggested the U.S. Department of Justice investigate Rubensteins practices. That never happened, but the issue remained. It stemmed from a May misdemeanor case and an Oct. 6 letter from Hamilton County Public Defender Ray Faller to a Cincinnati official. The letter complained about the lack of oversight on Rubenstein and his office and how Faller believed Rubenstein trampled the rights of accused criminals. Specifically Faller had concerns about Rubensteins actions involving prosecution of a man accused of stuffing $200 in candy from a convenience store down his pants and leaving. The mans attorney, assistant public defender Scott Nazzarine, got a video of the incident from the store. Prosecutors waited too long to do that and the store erased the video. That meant the lawyer for the accused had the key evidence prosecutors needed. When Nazzarine refused to hand it over, fearful it would violate his duty to his client, Rubenstein got a warrant to search the entire Public Defenders office, outraging Faller.
