Itama po natin! By: Ben Lou Q: I received a summons for an unpaid debt that I have ignored for 2 years. How do I go about this problem? A: I have said before that when we leave problems unattended, they tend to get worst. This is a good example. Let me explain what has transpired in the last 2 years since you stopped paying this debt. After having stopped paying on the debt, they tried to reach out to you by phone, by mail, sometimes by registered mail. Their efforts to reach you were ignored. The next step for them after a few months of unsuccessfully trying to reach you was to transfer the debt to a collection agency. These collectors are relentless in calling and writing letters in order to get a hold of you. Sometimes going as far as violating your consumer rights by calling your work place but were still ignored. Next the bank will take the hit and sell your debt to a debt buyer. When this happens, you no longer owe the bank the debt. The debt buyer bought your debt for an extremely low price per dollar in hopes that he will collect the debt in full and make a profit on his investment. Once the debt ends up with the debt buyer, they will be more aggressive in collecting the debt from you since he had to pay for it. Still being ignored, they contact an attorney who specializes in collections and asks them to sue you. These attorneys will then send you a letter to respond in 30 days if you dispute the debt or face a lawsuit. Most of the time, people who no longer want to deal with an unpaid debt will ignore this warning letter but this is the last letter you will receive before receiving a summons. Thus, a summons is received. In essence, a summons is a court ordered tap on your shoulder that someone has filed a complaint against you. You are given so many days, usually from 20 to 30 days to reply by filing an answer through the court system as well. If you do not reply, which is what most people do is ignore this as well, you automatically loose by default. This is when it gets worst because now they can ask the court to grant them ways of collecting the debt either by wage garnishment, bank levy or real property liens. So, if you received a summons, give me a call. I have experienced attorneys who will respond and put you in a program which will eliminate this debt with less money than you owe.
