JUDICIAL IMPLICATIONS OF DEVIATING FROM THE PROPER PATH IN AN ISLAMIC STATE AND THE NEED TO GIVE DUE REGARD TO THE RIGHTEOUS SCHOLARS by *Ibn Abdillah As-sudaisiy In the Name of Allah, the Beneficient, the Merciful All praise is due to Allah, the Lord of the worlds. I bear witness that there is no one worthy of worship except Him. I testify that Muhammad, sollaLohu alaihi wasallam is His Messenger and Apostle. May Allah shower His blessings upon him, his household, the Companions and the Taabieen. Indeed, the best of speeches is that of Allah, the best of guidance is that of the Prophet, sollaLohu alaihi wasallam, the worst acts are the ones innovated in the deen, all innovations are misguidance and all misguidance is Hell-fire. May Allah save us from this. Some people among this ummah would not stop amazing the right thinking members of the Muslim community. Among them are; 1. Those who claim to have hidden knowledge inspite of the provisions of Q6:59; 6:73; 7:88; 27:65 2. Those who interpret the shariah based on thier own common sense without proper knowledge of the Usul Fiqh despite the clear provision of the Quran Ask the people of knowledge [the Scholars] if you dont know (16:43) 3. Those who base their Islam on innovations and fabrications inspite the provision of the Quran This day, I have perfected our religion for you, completed My Favour upon you, and have chosen for you Islam as your religion. But as for him who is forced by severe hunger, with no inclination to sin (such can eat these above-mentioned meats), then surely, Allah is Oft-Forgiving, Most Merciful (Q5:3) 4. Those who reject the verses of the Quran and authentic hadiths of the Prophet, sollaLohu alaihi wasallam because it does not appeal to their poor intellects. These kind of people are misled and are misleading other people about issues that had been clearly established in the Quran and Sunnah of the Messenger of Allah, sollaLohu alaihi wasallam. If we ask questions from the real scholars; you will understand Islam better, rather than subjecting the shariah to your own personal and defective opinions and assumptions. The Messenger of Allah, sollaLohu alaihi wasallam was reported to have said; He who speaks about the Quran on the basis of his own personal opinion (by any accord) he commits an error, even if he is right (Tirmidhi and Dawwud) Had it being we are in a pure Islamic state, many people would have been imprisoned, severely tortured or even executed judiciously for their acts and statements of bidah and kufr. Just imagining that we are able to establish an Islamic state where we can have an Amir of Umar Bin Khattabs example; what would have been the fate of the Ahlu bidah who utter what they like about the deen; or the deviant people among this ummah who worship and call their gods and secret leaders beside Allah; or the Khawaarij who takes laws into their hands? One of the clearest ways of identifying kufr is rejection of the Kitab wa Sunnah or any part thereof. Dont we read historical passages of the Quran and see how Allah, subhanahu wataala dealt with those who rejected the truth in the past? In Suratul Qaf, Allah says: And how many a generation We have destroyed before them, who were stronger in power than them, and (when Our Torment came) they ran for a refuge in the land! Could they find any place of refuge (for them to save themselves from destruction) Verily, therein is indeed a reminder for him who has a heart or gives ear while he is heedful (Q50: 36-37)
