John Boehner thinks he is being clever, but he is playing a high-stakes game. You dont have to be either a constitutional lawyer or a politician to understand what the Orangeman is doing. It isnt rocket science. By suing the President, The Speaker hopes to mollify the Tea Party faction of his caucus, who seem almost hellbent on impeaching the President in a grandstanding act of political self-immolation which has the potential to ignite a civil war. Boehner is wilier than he appears with his choleric complexion and rheumy eyes. He knows that the DC Circuit has consistently refused to hear similar suits by denying standing to the litigants. Boehner, no doubt, hopes the Circuit will refuse him standing, whereupon he can tell his caucus that he tried and add his active participation in yet another quixotic tilt at the executive branch to his bona fides as a true conservative. He will need that bona fides come next Fall, since his plans appear to include another term as Speaker. Of course, The best-laid schemes o mice an men / Gang aft agley, The DC Circuit could hear the case and issue a ruling which will be appealed to the Supreme Court. In a stunning but predictable move of judicial arrogance so characteristic of the Roberts Court, there could be a 5-4 decision against the President, one which rivals Bush v. Gore in its recklessness and utter stupidity. Such a ruling, of course, would serve as the foundation for the House to vote several articles of impeachment, which would ignite a firestorm of sectional hostility, the likes of which this country has not seen since 1859. Boehners only recourse then would be to pour himself another bourbon, light up a smoke and say Oops. So, as with much of the Speakers 21st century career, todays gambit is high stakes. He miscalculated badly about the willingness of his outliers to actually shut down the government, and we all know how well that turned out. Lets keep our fingers crossed that the Speaker has not underestimated the stupidity of the DC Circuit.
