KY environmental regulators are so understaffed they can no longer effectively enforce clean water rules. James Bruggers of the Louisville Courier Journal reports today on an important breaking story in Kentucky. Franklin Circuit Court Judge Phillip Shepherd has handed a major legal victory to several groups, including KFTC, who sued one of the largest strip-mining companies in eastern KY for thousands of Clean Water Act violations. The judges ruling also blasts the state agency responsible for protecting our water, and points blame at state policy-makers who have drained that agencys funding. In his opinion Judge Shepherd wrote, With only a handful of enforcement personnel, and a dwindling number of field inspectors, it is impossible for the Cabinet to effectively regulate (coal companies) such as Frasure Creek who systematically violate the (Clean Water Act).
