Many thoughts came to mind when I first saw this....and once again the government has managed to create a misleading campaign of hatred and and misplaced anger. The case is Putting forth the idea that the commonwealths rescue service boats that were un-seaworthy SHOULD have been functional or at least have a functional boat prepared for rescue of any kind....That is the only point being made. If it were Australians who paid the price, people would be asking the very same question....tricky. Under both international law and domestic law vis-a-vis the Migration Act we are legally responsible for any foreign vessels in Australias territorial waters. There have been thousands of cases in which people have sued for apologies....but it doesnt really matter whether they are asking for money or not. From the articles and the case paper I have read...the point or argument being put forth is negligence of faulty equipment. It is unfortunate that it had to be seekers to put the case forward as it will be quite a fight, both in court and in the public eye. But when you think about it...if it was an Australian boat with tourists or the like on it and the governments rescue boats were out of action thus having to resort using ill equipped transportation to rescue, people would be up in arms over it now wouldnt they. Dont take my word for it, read the Coroners report: coronerscourt.wa.gov.au/.../Christmas_Island... From pages 96-98: It was the responsibility of the Commonwealth in the form of the Department of Regional Australia and the AFP, to ensure that there were suitable vessels on the island for an emergency at sea response at all times. The agency with primary responsibility for a search and rescue response was the AFP an d that agency did not have access to a suitable vessel. The volunteers comprising the VMRS were a group of dedicated residents who were willing to provide assistance in the event of an emergency at sea occurring. Unfortunately their organisation was also not provided with a suitable vessel. This failure on the part of the Commonwealth meant that there was no effective capability on the island to respond to an emergency at sea. For such an isolated island posing significant dangers for visiting vessels, this was a major failure. A sea rescue service should be ready for rescue at all times.
