Mediation – a new legal alternative Mediation will came into effect on 1 December 2014. Mediation is a process by which a mediator assists the parties in actual or potential litigation to resolve the dispute between them. What are the benefits of mediation? • It is less costly than court litigation. • Technical court rules of procedure do not apply. • It is voluntary process from which the parties can withdraw at any time. • It can provide a win-win solution, whereas litigation outcomes are win-lose. • On-going relationships between the parties are positively impacted. What does mediation cost? There are no court fees, but the mediator is entitled to charge a fee according to a fixed tariff. The Parties contribute equally to this fee, which must be into court before mediation commences. Some mediators act pro bone (without charging a fee).
