IN THE MATTER OF BEFORE THE TEXAS NINIA MARGELY CAMACHO REAL ESTATE COMMISSION CARROLTON TX SITTING IN AUSTIN UNLICENSED TRAVIS COUNTY, TX AGREED ORDER On Sep 25,2014 ,Nivia Margely Camachi (“RESPONDENT”) was notified of allegations against her, In order to conclude this matter, Respondent admits to the truth of the following Findings of Fact and Conclusions of Law and agrees to the entry of this Order assessing an administrative penalty. FINDING OF FACT 1. At all times relevant to this matter, Respondent did not hold a Texas real estate broker or salesperson license. 2. Between May 21, 2009, and September 25, 2014 Respondent engaged in real estate brokerage activities using her daughter’s identity. More specifically, Respondent engaged in real estate brokerage activities in Texas using the Texas real estate salesperson license number 577009 and the name Margely G Camacho. 3. Respondent engaged in real estate brokerage activities in Texas in association with Texas real estate (broker). 4. From about January 1, 2003, to about May 24,2013, Respondent received commissions or fees paid through Broker for her real estate brokerage activities in Texas realeted to six or more properties. 5. At the times between May 21, 2009 and September 25, 2014 Respondent used several additional names, including “Margie Camacho” and Nivia Montalvo”. On or May 10,2013, Respondent filed online an application for a Texas real estate for a Texas real estate salesperson license using the name Nivia M Montalvo (application),and responded “NO” to the questions in the Application which asked whether she had ever..acted or attempted to act as a as a real estate broker or salesperson or APPRAISER IN Texas AT a time when not property licensed . While the application was pending Respondent engaged in one or more real estate brokerage transtactions in Texas. Allowed, and the Spplication expired after one year. CONCLUSIONS OF LAW The acts and commissions on the part of Respondent set out in the Findings of Fact constitute the following violations that are cause for the assessment of an administrative penalty against Respondent to Tex Occ.Code & 1101.701: 6. Acting in the capacity of, engaging in the business of, or advertising or holding herself out as engaging in or conducting the business of a real estate salesperson or broker without first obtaining a real estate license, in violation of Tex Occ. Code 7. Acting, while an applicant for a salesperson license, as a broker or salesperson before the person receives a license evidencing that authority , in violation of TEX Occ. CODE & 1101.351(B)
