One week before Thanksgiving the Senate Democrats passed a new rule with a small majority vote of 52-48 to invoke the nuclear option. While the White House and liberal Democrats may be able to give thanks for this unbelievable power grab, the rest of America should be very ungrateful. For those of you who don’t know what this nuclear option is, it is a change in the senate rules that allows a simple majority, or 51 votes, to end debate and move to a majority vote on all executive and judicial appointments except for a Supreme Court appointment. Before the current nuclear option was invoked, a super majority of 60 votes was required to end debate on all appointments. President Obama came out after the vote and said that this vote was necessary because “the gears of government have to work” and that what the Republicans were doing was “not what the founder’s envisioned”. While this change in Senate rules only applies to judicial appointments, other than the Supreme Court nominees, it is still, as Vice President Biden would say, “a big *freaking* deal”. This power grab by the Democrats essentially gives President Obama and liberal Democrats an open door to appoint anyone and everyone they want to key court positions without any interference from the minority party. The reason this is such a big deal is that President Obama has a specific agenda and in order to get that agenda pushed through with as little interference as possible he needs to have the DC Circuit Court appointments to be tipped in his favor. According to the Wall Street Journal, The U.S. Court of Appeals for the District of Columbia Circuit holds “a special place in the judicial hierarchy, serving as a crucible for the regulatory state and a proving ground for judges aspiring to the Supreme Court.” The DC Circuit Court has handled cases “involving the Pentagon Papers, the Watergate tapes and President Harry Truman’s seizure of steel plants helped set the bounds of executive power. The court overturned the convictions of notable public figures, from playwright Arthur Miller, who had refused to ‘name names’ of suspected Communists, to Marine Lt. Col. Oliver North, who had been found guilty of obstructing congressional investigations into the Iran-Contra affair.” Most recently the DC Circuit Court struck down the controversial Obamacare “birth control mandate” paving the way for this fight to go all the way to the Supreme Court. The DC Circuit Court is seen as one of the most, if not the most, powerful lower-court in the country, and that is the reason President Obama needs the court in his favor. Another problem with the nuclear option invoked by Harry Reid and Senate Democrats is that it opens the door to invoking the nuclear option for other senate rules, such as only having a simple majority for Supreme Court nominees, and a simple majority to invoke cloture on other senate bills. If these nuclear options were invoked, the United States would no longer be a Constitutional Republic, but rather a unilaterally run totalitarian state. The only way we, as conservatives, are going to save our country from this unbelievable power grab is by doing two things. 1) We, as voters, must put pressure on vulnerable Democrat Senators when it comes to their court appointment votes. Politicians only care about one thing and that is getting reelected. If these certain vulnerable senators think that voting for a specific court nominee, after invoking the nuclear option, will hurt their chances of getting reelected in 2014, they will be more likely not to vote for that court nominee. 2) We MUST vote out every single Democrat (and maybe a few RINO’s) up for reelection in 2014. If we don’t – it will be the end of our country as we know it. The Democrats in Congress are betting on the fact that most low-information voters will not understand the repercussions of the Senate’s actions and will continue to vote for them anyway. We must make sure that every person, from the north, south, east, and west understands what just happened and help educate our neighbors about the direction of our country. This is the only way we can hold the left accountable for their inexcusable actions. 2014 is coming fast and we can no longer afford to sit on the sidelines and wait for someone else to do something about the direction of our country – we must be the ones to do something about it – starting right now.
