Respected Elders & Friends, Subject - HUF status Regarding a specific query raised by many on possible loss of HUF status is also due to the fact that we have never discussed this issue threadbare. We always rely on our own conviction which are so strong that we fail to re verify. I am glad that some have raised the same esp.. Some of the youth associations, that is the advantage of having young minds at helm who are always open in their mind. In this context suffice to say that Article 25 , 29 and 30 of Constitution of India enables us to demand Minority status to preserve our culture, religious practices and institutions. It just gives us right to establish and administer our institutions be that religious cultural or educational. As have been already told to you reservation issue and economic assistance is a political demand. I also wish to add that in managing personal social matter Hindu Law was enacted. This pertains to property, inheritance, Guardianship, Marriage, Income tax provisions divorce, Maintenance etc etc.Its clear that the word Hindu is defined to mean members of Hindu, Sikh, Budhsit and Jain religion under the said act. Even Explanation II in Article 25 ensures the definition Also it is a truth that under NMC act 1992, Sikhs and Budhist attained Minority status but Jains were left out predominantly due to opposition by our own community for sheer lack of vision. We have maximum wealth in such institutions and temples and thus we have compromised our right to administer the same without state interference or fear of take over in future and have not insured the interest of children and grandchildren by refusing to accept Minority sttaus which was offered on platter in 90s. The consequences have been fatal during our own life time vide case studies on Kesariyaji, Girnar etc.. They are lost as heritage site for ever from the administrative control of Jain samaj directly I hope the above clears distinct separation from Minority in constitution and word Hindu in Hindu personal law. Tell people boldly that HUF status cant be disputed just because a religion is declared Minority under National Minorities Commission Act 1992 ( NMC Act 1992) ( inputs shared by Daman Prakash Rathod sa) Rgds U.Sudhir Lodha State Minorities Commission Member, Government of TamilNadu, India.
