Something seems fishy: Residents challenged the project and won at a hearing before the Metropolitan Development Commission. Reliant appealed that decision, and at the appeal in February, the residents won again. The vote announced at the hearing was 5-3 in favor of residents. But this is where the story becomes complicated. It was later reported that the vote was miscounted. The commissioners’ votes were now determined to be a tie, 4-4, requiring a rehearing of the case. Before the rehearing, one commissioner resigned, and one commissioner was moved to another department. Both had voted for the residents.
