Sometimes it is difficult to figure out what is motivating an employer to terminate the employment of an employee on their staff. With regard to age discrimination, in addition to one’s age being an indication, there may be statement which imply an illegal motivation on the part of the decision maker. Examples of age based statements are as follows: “We are looking for fresh ideas.” “Why are you still working? You should be retired by now, playing golf.” “We’re a young company.” “We are vibrant and energetic.” “Our team is young, energetic and bright.” Examples similar to these may constitute the proof that one needs to successfully bring a age discrimination claim.
