TEACHERS’ DAY SPECIAL AN APPEAL Teacher’s day is celebrated in our country every year with great pomp and show. It is the right and most appropriate time to do our bit to pay back our teachers in our own way. Many educational institutions (private) are denying the retired teachers their right to Gratuity, and are giving them a run. Our teachers sacrificed their lives to make us what we are today, and they are being denied what is rightfully theirs. Here is an appeal for individuals, employers of private educational institutions, officials of respective labour departments, judiciary; members of ruling parties; members of opposition parties; teaching staff; printed media and electronic media. A little background: As per provisions of the PG Act, it was the prime responsibility of the employers to determine the amount of Gratuity and pay to the beneficiaries within 30 days of their retirement or from the publication of the said Amendment Act. Moreover, it was the duty of the labour department to get the Act implemented in accordance to the labour policy of the respective states. But in many states, employers have not yet determined the amount of Gratuity payable to their retired teachers/employees, raising a question mark on their intent and not paid the amount alongwith interest, as admissible under the PG Act, 1972. The respective labour departments are required to intervene in the matter and should have ensured the compliance of provisions of the said Act. The department is silent too, for the reasons well known to them. On the contrary, if any one dares to approach Controlling Authority (labour officer) for directing the employer to pay the Gratuity, his/her application is grossly mishandled. After giving the person a run around, he is being directed to take the legal action.. This issue is no less than a scam brewing; the amount owed to these teachers must be to the tune of a few million rupees, and there is absolutely nobody who is listening to the teachers and working his/her bit for this rightful cause. APPEAL TO INDIVIDUALS: To spread the message to as many people as you can through social media or by any other mode APPEAL TO PRIVATE EDUCATIONAL INSTITUTIONS: To comply with the provisions of ‘The Payment of Gratuity Amendment Act, 2009’ in true spirit and pay the legal dues to the retired teachers gracefully. APPEAL TO OFFICIALS OF LABOUR DEPARTMENTS: i) To inspect the establishments of private educational institutions to ensure compliance of ‘The Payment of Gratuity Amendment Act, 2009’ falling under their jurisdiction;& ii) To initiate stringent action against the defaulting institutions. APPEAL TO JUDICIARY OF INDIA: To take cognizance of the facts suo motu and issue directions for all concerned in this regard. APPEAL TO RULING PARTIES: Ruling parties in the Centre and in all States to ensure the implementation of the Act by giving full page advertisement in leading news papers. Advertisement should contain the facts of the Amendment Act and instructions to the employers to comply with the provisions of the Act. A dead line to be fixed by the government for employers for compliance, failing which stringent action to be initiated against the defaulting employers. APPEAL TO OPPOSITION PARTIES: i) To question the government for non implementation of the Act with reasons thereof; ii) To ask for the amount of outstanding amount of gratuity payable to retired teachers; & iii) Details of action taken by the labour department against the defaulter institutions. APPEAL TO TEACHING STAFF: i) To unite together and fight till you get your rights. APPEAL TO MEDIA: i) To give wide publicity to the issue, till the same is resolved; ii) To ask the relevant officials the reasons for their negligence in performing the duties; Sincere efforts of any person in this regard would be truly and sincerely appreciated by YOUR teachers…
