THE REPLIES TO YOUR QUESTIONS From: Faysal Mujaahid To: Abdullah Al-Gbadaawi In the name of Allah, the beneficent, the merciful. I’m very sorry to have delayed the reply to your questions and this was as a result of the instability of the power supply. I hope I don’t need to repeat the questions anymore, I will rather highlight them one after the other and make a brief and detailed explanation. * REGARDING SUICIDE BOMBING This issue is a Fiqh issue and not an issue of kufr and Eemaan, where we know those who are Ahlus Sunnah, Khawaarij, Murjiah and other sects. This issue is a Fiqh issue which can be halaal or haraam. If we all understand this then, Alhamdu lillah! Therefore, even if we deem suicide bombing to be wrong, its erroneous to call people Khawaarij, Kuffaar...on account of that. Ahlus Sunnah wal-Jamaa’ah do not pronounce anyone as Kuffaar or Khawaarij or Murji’ah and the likes except for deviation in issues of kufr and Eemaan but, as for errors in Ahkaam then NO. Those who pronounce others as Kuffaar on account of errors in Ahkaam, such people are upon the manhaj of the Khawaarij and no doubt!!! When Ahmad An-Najmi was trying to defend Madkhali, he said: “I phoned Shaykh Rabee’… about (his statement that) one who abandons jins Al-‘Amal (the category of actions) is not a kaafir. (He said that) Shaykh Rabee’ replied, ‘It’s a lie! I never say so. What I do say is that anyone who abandons an obligatory act in Islam is a zindeeq (Heretic) and a kaafir (disbeliever)’.” When I read this I laughed, though I do not believe that this statement was said by Madkhali… Ahmad An-Najmi was only trying to defend him but, this statement is like washing a dirty cloth with urine; this is actually the statement of the Khawaarij, they regard people as Kuffaar for abandoning any obligatory act or doing any forbidden act. So, it’s only an ignorant who pronounces people as Khawaarij and Kuffaar on account of suicide attack which is a fiqh concept and not in any way related to kufr and Eemaan. It’s very wrong and a clear deviation to do so. This is a fiqh matter and we – alhamdulillaah – do not call it suicide we, rather call it “Istish’haad (martyrdom)” this is because we understand the concept clearly. Allah says: “Do not kill yourselves; Surely, Allah is most merciful to you. And whoever commits that THROUGH AGGRESSION AND INJUSTICE, we shall cast him into the fire…” [Q 4:28] And Allah says, “Do not throw yourselves into destruction” [Q 2;195] In this verses, Allah forbids killing oneself…so thus, it is to be stated that the evidences for the prohibition of suicide are general (‘Aam) while the matter of suicide to kill a large number among the Kuffaar is specific (Khaas) and the evidence that is general cannot be used for matter which is specific… I hope this is not hidden in “Usuul ul- Fiqh!!!” A typical example for this is, is that Islam prohibits making du’aa’ for death upon one’s self for any disaster which has fallen upon him. The prophet salla llahu ‘alayhi wa sallam said, “Let not any of you wish for death on account of a harm which has befallen him…” [Sahih Bukhaari #5671] It is to be stated that this prohibition is general while wishing for death on a battle field against the Kuffaar is specific, and the evidence that is general cannot be used for that which is specific. The prophet salla llahu ‘alayhi wa sallam said, “By [Allah] in whose hand is my soul! I have surely wished to be killed in the path of Allah, then brought to life then killed [again], then brought to life then killed.” [sahih Bukhaari (36, 7226)] So, there is no doubt that the prophet salla llahu ‘alayhi wa sallam hoped for death and he encouraged others to also seek death but, this is death in the path of Allah while it is forbidden to seek death for any worldly purpose or grief over this life. And it is known also, that the Muslim is forbidden from immersing himself in places where he will be destroyed or killed but, if this is done in the path of Allah, for the benefit of Islam and to raise the flag of tawheed then, this becomes legal and praiseworthy as reported by Abu Hurayrah, “Among the best of people, is a man who clasps the reins of his horse in the path of Allah, flying on his back, whenever he hears a call (for battle) or advancement towards the enemy – he flies to it – seeking death and being slain with eagerness..” [Sahih Muslim #1889] So, in this hadith, we see that the intention has altered the hukm (ruling) and that is why the prophet salla llahu ‘alayhi wa sallam said, “The reward of deeds depends upon the intentions…” [Sahih Bukhaari] The pestering Jews are the gatherers of all the shameful defects and the collectors of the aggravations and the evils and they are the harshest enemies of Allah against Al-Islam and its people. He, the Most High said: {“Verily, you will find the strongest among men in enmity to the believers (Muslims) the Jews and those who are Al- Mushrikun.”} [Q 5:82] And Allah has made compulsory the fighting against them and making Jihad against them so that the Word of Allah is the highest and the word of those who disbelieve is the lowest. Yet all this is when the enemies of Allah remain within their states and do not break their contracts and covenants and do not seize the wealth of the Muslims and overtake their states. He, the Most High said: {“Fight against those who believe not in Allah, nor in the Last Day, nor forbid that which has been forbidden by Allah and His Messenger and those who acknowledge not the religion of truth [i.e. Islam] among the people of the Scripture [Jews and Christians], until they pay the Jizyah with willing submission, and feel themselves subdued.”} [Q 9:29] But when the enemies of Allah place their swords upon the throats of the Muslims and terrorize their young and their elderly and overtake their states and violate their chastity, then it is obligatory from among all the people of ability to fight them and spill their blood and make ongoing Jihad against them until the full liberation of Palestine and all the countries of the Muslims. And it is not allowed in the Sharee’ah to surrender any of the lands of the Muslims to the Jews or to make peace with them because they are a people of deception and deceit and of breaking of treaties. And I see that in this time, in which the Muslims are unable to [fully] fight the Jews and destroy them and expel them from the Holy Land, that the best treatment and the greatest medicine that we apply to the brothers of the monkeys and the pigs [i.e. the Jews] is that we perform the suicide operations and put forward our souls as a ransom for motivation of Eemaan and for praiseworthy goals from planting the fear in the hearts those who disbelieve and inflicting harm upon their bodies and losses in their wealth. Allah the Most High says: {“And of mankind is he who would sell himself, seeking the Pleasure of Allah. And Allah is full of Kindness to [His] slaves.”} [Q 2:207] And from the narrations of the Sahaabah and the Imams of those who witnessed them, concerning the meaning of this verse is a strong evidence concerning that the one who sells himself to Allah and plunges into the ranks of the enemy headlong, without retreating, even if he is certain that they will kill him, that he is a Muh’sin [i.e. sincere in his devotion] in that and that he receives the rewards from him Lord with the patient ones and the hopeful martyrs. And in Sahih Muslim #3005 from the path of Hammad Ibn Salamah, Thabit al-Banani narrated to us from Abdur-Rahmān Ibn Abi Layla from Suhayb from the Prophet, peace by upon him, in the story of the Sorcerer and the Monk and the Boy. This Hadith; and in it the monotheist boy proclaimed to the Kaafir King, “…you will not be able to kill me until you do what I order you to do.” He said: ‘And what is that?’ He said: ‘You join all the people on an upland plain and crucify me upon a tree trunk. Then take an arrow from my quiver and place the arrow in the bow and then say, ‘In the Name of Allah, the Lord of the boy,’ and then shoot me. And verily, if you do that, you will kill me.” So he joined all the people on an upland plain and crucified him to a tree trunk and then he took an arrow from his quiver. The he placed it in the bow and said: ‘In the Name of Allah, the Lord of the boy,’ and then he shot him and the arrow entered the temporal region of his skull. So the boy put his hand over the temporal region of his skull and then he died. So the people said: “We have believed in the Lord of the boy, we have believed in the Lord of the boy, we have believed in the Lord of the boy!” So the king was approached and it was said to him: “You know what you were afraid of? I swear by Allah that that which you were afraid of has fallen upon you. The people have believed.” So he ordered for trenches to be dug out of the mouths of paths. So the fires were lit and he said: ‘whoever does not turn back from their religion [i.e. Islam], I will throw him in it or he will be commanded: ‘Jump in it!’ So they did that until a woman came and she had with her an infant boy and she was afraid for him to enter it. So the boy said to her: ‘O mother, be patient because verily, you are upon the truth!” So in this, there is evidence for the correctness for these suicide operations that the Mujaahideen in the Path of Allah perform; those who are waging war against the Jews and the Christians and those who make mischief in the Earth. This is because; the boy instructed the King the means with which to kill him when the King was unable to do that after trying unsuccessfully and seeking the help of the soldiers and aids. So this action of the boy; within it there is the method of the killing of himself and [the one who instructs how to kill is the] partner in that. His judgment is the same judgment as the one who killed him. And the goal of these two matters [i.e. the story of the boy and the infant boy commanding his mother to jump into the fire] is making the truth apparent and supporting it, and evidence for inflicting harm against the Jews and the Christians and the Pagans and their supporters and weakening their strengths and planting fear in their selves. He, the Most High says: {“And make ready against them ALL YOU CAN OF POWER, including steeds of war [tanks, planes, missiles, artillery, etc.] to terrorize with it the enemy of Allāh and your enemy, and others besides whom, you may not know but whom Allah does know.”} [Q 8:60] And most of the people of knowledge had permitted for the Muslim to plunge himself headlong into the ranks of the disbelievers even if he is certain that they will kill him. And the evidences for this are many and can be found in the book entitled “Al-Mukhtaar fii hukmi l-intihaar khaofa ishfaa’ Al-Asraar (The ruling regarding killing oneself to protect information).” You can download the book here: muwahhidmedia.files.wordpress/2013/07/protect_information.pdf * REGARDING SHAYKH USAAMAH BN LADIN Shaykh Usaamah bn Ladin is the one who revived the Ibaadah of Jihaad after it had been abolished by the Kuffaar and after the worldly scholars had ignored it by one means or the other. But, the shayaateen (I mean Saalih Fawzaan, Rabee’ Al-Madkhli and their followers) pronounce him as a khaariji and a kaafir. They did this upon him for no reason other than the reasons why I was also called a khaariji and a kaafir. The shayaateen regard him as a kaafir and a Khaariji for the following reasons: * Sahykh Usaamah established jihad against the Kuffaar when Muslims have no Khaleefah. * And he made takfeer upon the apostate rulers; those who do not rule with the Sharee’ah [this is an obligation upon all Muslims.] As for we Muslims, upon the manhaj of the salaf – we believe that Shaykh Usaamah is the Mujaddid of our era, the leader of the Mujaahiduun, may Allah bless him and include him among his Shuhadaa’ (martyrs). * ABOUT SAYYID QUTB (MAY ALLAH HAVE MERCY ON HIM) Sayyid Qutb is one of the wonders of this time of endless wonders that one would ask about this exemplary sayyid and speak to either injure or set right. He is the one who separated himself from this worldly abode, mastering its trivialities, vanities and crumbs which most of mankind craves and immortalizes and which the Tawaagheet offer to their submissive, obedient people. He, may Allah have mercy on him, refused to write with the fingers that penned “In the Shade of the Qur’an”, and Tawheed words that would save his neck from death, by using them to obscure truth with falsehood or acknowledge the rule of the Taaghuut... However, Sayyid Qutb was not a scholar; he was rather an ordinary man who had a great zeal for Islam despite his little knowledge. Im free from those who pronounce him as a Kaafir because most of what they accused him of are lies and others are errors which do not reach the degree of kufr; they are things which slipped from his pen and were corrected elsewhere. An example of the lies attributed to him by Madkhali is that Sayyid Qutb believed in wahdatul wujuud (unity of existence) though, Sayyid Qutb may Allah have mercy on him, said something not clear that might make the reader think that he believes in Wahdat Al-Wujuud using the style of literature in commenting on Suurat Al-Hadeed, and Surat Al-Ikhlaas, and based upon it the accusation that he believes in Wahdat Al-Wujuud was made. But, Sayyid clearly rejected the idea of wahdatul wujuud somewhere else, he - may Allah have mercy on him - said: “The Islamic view draws a distinct line between Creator and creation. The Creator is unique and matchless, which leaves no room in Islamic thought for the idea of “Wahdat al-Wujuud” or pantheism. NON-MUSLIM PHILOSOPHY relies on the idea to indicate that creation and the Creator are one and the same; that creation is a mere reflection of the Creator and the physical manifestation of its Maker…….” [See: Fii Dhilaal al-Qur’an - Volume 1, Page 122 Eng Trans] or [Fii Dhilaal al-Qur’an – Sayyid Qutb – Volume 1 (Surah 1-2)] Another lie against him is that “Sayyid Qutb confirms the belief that the Qur’an is created, and that the speech of Allah is just the will.” Going back to the pages that talk about that, we did not find a single letter where Sayyid Qutub, may Allah have mercy on him, declared this saying: “The Qur’an is created.” If he had even said this, do we accuse all people by the saying that the Qur’an is created without explaining to them? O Allah No. My brother! Let’s enter a market and start asking the buyers and sellers ‘Is the Qur’an created?,’ by Allah! Majority will say ‘yes’ regardless the fact that they all know that the Qur’an is the speech of Allah. What I want you to understand is that the issue that Quran is not created is only known by few people so, it needs to be explained. The shayaateen also said that Sayyid Qutb allows other than Allah to legislate. “Glory be to you (O Allah), This is a great lie!” By Allah in whose hand is my soul! Sayyid Qutb never author such in any of his books rather, Sayyid Qutb based his life upon and dedicated his pen for: the da’wah towards the monotheism of Allah “in ruling and legislating,” rejecting the man made laws, and confronting those who committed that (legislating and ruling by other than Allah’s rule). Shaykh Al-Maqdisee was asked: Question: In the name of Allah, the Compassionate the Merciful. Praise be to Allah, Prayers and Peace be upon the Prophet of Allah. Esteemed Mujaahid Sheikh, Peace and the blessings and mercy of Allah be upon you, we beseech Allah to release the Monotheist Mujaahideen preachers everywhere. Our esteemed sheikh, my question pertains to Sayyid Qutb, may Allah have mercy on him. In truth, I have tried strenuously to find your opinion on Sayyid Qutb but could not find it. Perhaps you have said something on this matter but I couldn’t find it. My question is this: I wish your opinion on this man, because I trust you. May Allah reward you. *** Shaykh Al-Maqdisee answered: In the name of Allah, praise be to Allah, blessings and peace be upon the Messenger of Allah and upon his House and his Companions, and those who are loyal to him. Dear brother (…) May Allah protect him and make him among the supporters of His Religion. Peace be upon you, and the blessings and mercy of Allah. With regards to the Mujaahid and the esteemed writer, our great teacher Sayyid Qutb, may Allah Almighty have mercy on him: It is one of the wonders of this time of endless wonders that one would ask about this exemplary sayyid and speak to either injure or set right. In a time when many of his contemporaries brought themselves and their newspapers into disrepute, including many old men who spoke slanderously of him, there was nothing baser than those words which he deemed beneath himself, may Allah have mercy on him. They subjugated their religion day and night to the tyrants and sold it for a trifling price without even being coerced or threatened with death and execution. Indeed, they hastened to do that as if (they were) hurrying towards an idol, slaughtering Tawheed on their altars and sacrificing their religion as an offering to them and a sacrificial lamb to the vanities of their material world. By Allah, if it were not that truth-saying and counsel according to the Book of Allah and the Sunnah of His Messenger are an obligation and a duty, I would not write a word on the Sayyid. For there are few men like him in our age. Of all who walked in this path, the Sayyid has precedence – willy-nilly, admitted or denied. No sayyid after him has been praised like he has or has been condemned like he has. Of him and of those like him, the following words are true: How the courteous Sayyid was reviled ~ By one who is not equal to even a stitch on the sole of his shoe? The corpses of the desert rose over the sea ~ And its achievement buried in its deepest recesses. With all of the above – the Sayyid was a man like most men and he both hits the mark and makes mistakes and his writings contain a number of known ERRORS. It is clear to one who followed his writings and distinguishes the old from the new that they are things in them of which one must be cautious and had promised to be corrected and amended. It is necessary for the sincere people who are near him – and at the head of whom is Mohammed Qutb – to complete this for him, and not to insist on leaving them as they are. For they remain a breach and a pretense for the sheep, the sickly and the degenerate who are food for the lion and the sultan to take as a pretext to challenge Sayyid and accuse him of innovation and accuse him of things of which he might be innocent, or things of which he is fundamentally innocent but on which the pen of this man of literature slipped and said what its owner did not mean and could not have imagined. An example of this is the speech attributed to him about the unity of existence: Sayyid absolutely – in everything he writes – differentiates between the Creator and the created. He magnifies the Creator and recognizes Him as One and declares as an infidel anyone who claims characteristics of divinity for himself or for others, aside from He who made all of existence. He is the first and the only One. Anyone who claims differently in this does not know Sayyid and does not know his books. What he wrote in some passages of al-Zilal are literary words. This difference is necessarily omitted by those jealous of the Sayyid based on his books, especially since they know and affirm that Sayyid does not mean the truth of these words and that he clarified this and other things in his other books like “Characteristics of Islamic Conduct”, which is one of the last of his books – may Allah have mercy on him. In any case, people have written about Sayyid with a mixture of negligence and exaggeration. Some people malign him and another people adore him. We – praise be to Allah - do count ourselves among the one or the other. But rather, we go where truth takes us. We do not think that infallibility rests with a person who came after the Messenger of Allah, peace and blessings of Allah be upon him. We reserve for Sayyid and those like him among the supporters of the Deen their right and we do not diminish what they have given. We love them for their steadfastness in following the right and their support for the Deen and its laws and their innocence from the Taaghuut and their shirk. We do not say this arbitrarily or out of partisanship or ignorance, for we, among those who read most of his writings at the very beginning, and knew him – praise be to Allah – and knew his Manhaj and his positions from close up, have heard his dissertations supported with high chains of narration from among those closest to him. By that I mean Sheikh Sayyid Yusif Ayd, who is one of those individuals, the number of which can be vaunted on one hand, who was commended by Sayyid, may Allah have mercy on him for their understanding of his dissertations and their absorption of his writings in words he wrote before his execution published under the title: “Why They are Executing Me”. On the other hand, some sheikhs have written remarks and warnings about some things that slipped from the pen of the Sayyid, and that is an affair for the people of knowledge. Upholding the truth is dearer to them than all people. Among them is Sheikh Mohammed Bin Abdullah AlDarweesh – may Allah Almighty have mercy on him who wrote the book: “The mistaken source of errors in al-Zilal”, he was on the mark in some things and was not successful in others. I read this book the year the first edition was published. At that time, I wrote for him an assessment in a letter that I called: “A Balance of Moderation in Assessing the book the Source of Errors”, I supported some of the things he wrote and I said others were errors and I pointed out some things that were omitted. I sent a copy of it to the Professor Mohammed Qutb and another to Sheikh Darweesh – may Allah have mercy on him – and he wrote some comments on it before he died. I still have the copy of it in his handwriting. Maybe we will distribute it soon with his commentary – Allah willing. This is what I have, to answer your question May Allah make us among those who follow His word, and follow what is good to Him. Sheikh Bakr Abu Zayd wrote a letter to Madkhali asking him to repent from the lies he invented against Sayyid Qutb, you can read it here: islamissunnah.wordpress/2014/09/09/the-golden-letter-to-rabee-al-madkhali/ As for your question about IS, indeed to determine whether a state is an Islamic state depends on a number of factors: Firstly: Its legislation by the Book of Allah and the Sunnah of His Messenger (salla llahu ‘alayhi wa sallam) in all the branches of ruling and other than it in other worldly dealings. Secondly: Indeed one of the most important components of a country is its control of land. Thirdly: That its relations and dealings with other countries are established on the basis of the Noble Deen. Fourth: The leader must be able to protect the Muslims from the harms of the Kuffaar and other than them. The Islamic state (IS) has been proven to fulfill these factors, so it is the only country in the World in which there are no man-made laws and legislations. Rather, indeed its legislation is established on the Sharee’ah of Allah and His Messenger in the Courts of Law, in the ministries, in the governmental circles and in other establishments. As for the Muslim countries other than Islamic state, amongst them are those which legislate with man-made laws in their totality and amongst them are those who contain Courts of Law which are man- made in their totality, but under the label of the Sharee’ah of Allah and His Messenger (salla llahu ‘alayhi wa sallam). Even the vast proportion of the rulings in the so-called ‘Sharee’ah’ Courts in these countries are based on man-made institutions and legislative acts, so in reality there is no difference between this type of ruling and the ruling of man-made laws except by name. Amongst the evidences that the Islamic State is a Sharee’ah Government is the fact that the disbelieving countries who are enemies of Islam and the Muslims are hostile towards it, have imposed an economic boycott on it, isolated it and tightened their grips on it for no reason other than its adherence to the Deen of Islam. As for the Mujaahiduun in northern Nigeria called Boko Haraam, based upon their stated agenda i.e. fighting for the implementation of Sharee’ah in its totality, I believe they are on the path of Allah according to the statement of the prophet salla llahu ‘alayhi wa sallam that: “Whoever fights for the prevalence of the word of Allah is indeed (fighting) in the path of Allah.” [Reported by Bukhaari] This hadith is general and not restricted. Lastly about the Kufr of the Saudi government, their kufr is numerous and I’ve released a fatwa on that and here is some of their kufr: 1. It operates both Kufr courts along with shareeh courts (the Kufr courts, they name it Deewanul muhãkamãt to cover it up. and all their kufr laws, they dont call it law (tashree) to deceive people, they call it order (nidhom) 2. It declared Riba (interest) permissible for people and banks through a Kufr law which they call Banks observation/control order (1386H) 3. It made it Haram to carry out the Hadd (shareeah punishment) of stealing on a person if the person is a military officer. According to another Kufr law which they call Register of military courts (11/11/1366) section 8 Article no. 112 4. It sponsored the establishment of UNESCO which is a Kufr organization. The aqeedah of UNESCO is: a. Islam was derived from Judaism, Christianity, and Arab Paganism; b. Quran is a book that does not have Balaagah; c. Qubuuriyyah centres (where sufi worship graves of their Sheikhs) is an Islamic center that should not be destroyed; d. Hadith is just fabricated by some people. Saudi government donated fifty thousand (50000) dollars for this Kufr organization to establish it in 1946 and advised it to spread its message in Africa and beyond. It also has an office inside Saudi. 5. It operates Kufr Commerce courts in Riyad which they call Gurfatu Tijãriyah (commerce room) to deceive people. Looking into the laws of this room and their kufr fake laws, Sheikh Muhammad bn Ibraheem (the Mufti before Ibn Bãz) exposed them and called it Kufr akbar, he advised them to refer all issues to the Shareeah courts and he said this reason alone is enough for people to rebel against the government. Check (Majmu fatawa Sheikh Muhammad bn Ibraheem Ãl Sheikh #4039 12/460 issued on 5/9/1375H) 6. It punishes and imprisons Muslims if they disregard, humiliate or dishonour any Kufr symbol or flag or kufr leader of any country if that country is friendly with them. The meaning of this is that if you break the cross which is the national symbol of many European countries or insult the leaders of Jews who are killing Muslims, you will be punished, imprisoned, and fined because all those are friendly nations according to their law (Legislations related to National symbols, royal symbols, and those of friendly nations (20/2/1393)) 7. It believes in international Kufr laws that is why it signed as a founding member of ICJ (International Court of Justice) and also signed that the laws of this Kufr court is binding on them and they will obey it. Nobody forced them to sign this Kufr, so many countries that are even completely Kufr refused to sign it till date. 8. It does not believe in Jihad Talabi (offensive war) legislated by Allah to be launched against Mushrikuun all over to capture their territory and bring them under the Shareeah so, it signed The Kellogg–Briand Pact (or Pact of Paris) (in 1931) officially General Treaty for Renunciation of War as an Instrument of National Policy. And we know that it is known by necessity in the religion of Islam that war is a National policy of the Ummah to be applied when appropriate but this Kufr country signed the agreement that it is harãm (Just like believing that Salah is harãm). e.t.c. e.t.c. e.t.c. to mention but few...
