The Bombay high court has ordered a stay on a July 23 directive of the University Grants Commission (UGC) to the Symbiosis International University (SIU) to discontinue its four-year undergraduate programme in liberal arts. The commissions impugned (under challenge) order is against the basic principles of natural justice, a high court bench of Justices Anoop Mohta and A S Gadkari said while granting the stay, as an ad interim relief. The bench observed, The respondent (UGC) never communicated and/or even asked any explanation and/or even issued a show-cause notice before taking such a drastic action. As per the order, the stay will continue till the pendency and final disposal of the writ petition filed by the SIU against the UGC directive through its lawyer Ravi Bhardwaj. The high court has given the commission four weeks time to respond to its notice of final disposal. Symbiosis University had argued that it was given no prior intimation, notice or a hearing before being given the closure order by the UGC. It pointed out that the four-year BA/BSc liberal arts programme was launched in 2011-12 following a one-time permission given by the UGC. The university had invested Rs 100 crore to start its school of liberal arts. The bench noted, We always respect the power and authority of the experts body, but at the same stroke, we are not inclined to accept the mode and method which they have adopted before taking such drastic action, which is nothing but resulting into closing of these courses which have been started by the university based upon the UGC approval,” reported ToI.
