This is an amazing evidence of judicial corporatism. This mountain man knows his rights and even the laws by number that gives him these rights. Obviously the judge is surprised by this and then (after 5:10) it becomes double interesting. The judge says: I have a paper with your signature on it, sir. It comes totally out of the blue, and what it means: for me you are not a living man, but a person on a paper; the paper is on trial and we allow you to speak for the paper; we will judge the paper and since you put your signature on it (that is the key!) you represent this piece of paper. In fact: she denies that he is a living person as far as the law is concerned. She tries to trick him into another prosecution, but he doesnt fall for that. There is nothing for her to do ...
