(1) Court offices throughout the country are not checking Declarations of Services as compliant with their own Court Rules and in addition it appears Solicitors for financial institutions generally are not informing the courts of An Post delivery records failure to deliver post (2) We Believe that An Post Delivery Records Should be produced as Evidence of service or of non service and not just the certificate of posting (3) There may be hundreds if not thousands of Court Judgments for possessions of homes and liquidated money demands and execution orders for goods where Defendants may in fact have never received initiating court documents , IE Civil Summons or Civil Bills. (4) resulting in court judgement s against defendants unknown to them. (5) These Defendants only become aware of judgement against when they receive notification from their local sheriffs office. (6) All the Banks claim to be in Conformity with the code of conduct for mortgage arrears ,when in fact they are manipulating it to give the impression of compliance. example; they demand a borrower to complete a statutory deceleration of means and then reject the document as incomplete for spurious reasons and then declare the borrower as non complaint and thus allowing and enabling them to proceed to issue the relevant court proceedings. (7) There are some finical institutions that dont even send out the forms but insist on taking the financial statement over the phone these calls can take over 2 hours and the borrowers have no record of their submissions provided through these calls and are never provided with a copy of there verbal submissions even for verifications purposes......
