7:45 PM last nite I was stopped by the Brick Police in front of a customers house. I was told that there was a report of an Unknown vehicle in the neighborhood. (lame reason #1) If it wasnt for the fact that my client was coming home within the next 5 minutes. I would of Respectfully told this officer that being an unknown vehicle is not a Crime, or reasonable suspicion that a crime is about to be committed ( Terry v. Ohio), Therefore I have nothing to say to you nor will I arbitrarily hand over my info. Call whoever you need to call or short of you beating my ass, exclaiming I resisted, Im not being what you will deem uncooperative, Im doing what the Constitution says I have an absolute right to do. At first I suspected my passenger might have a motor vehicle warrant. So I asked the officer why he must give his ID, (lame reason #2) criminals commit crimes together so the end result was. My passenger was arrested. (motor vehicle warrant) I was embarrassed in front of clients house and Im pissed that I had to surrender in this situation. Point...Resistance to surrendering constitutional rights to government isnt always easy, but must be done. If not, we are doomed to have Government arbitrarily kicking in doors pointing guns in our face and just taking our stuff and killing us in the name of enforcing the Law. The same tyranny that made us form the Constitution in the first place. Dont surrender your 5th amendment rights without first expressing that you wish to not answer any questions.
