A civil case has been filed before the High Court to have the Nakuru County sued over failed free Wi-Fi Nakuru Town East MP David Gikaria, the Rift Valley Law Society of Kenya and an NGO — the Counties Efficiency in Development want the county government ordered to provide residents with documents pertaining to the contract and proof showing who sanctioned the project and who funded it. They also want the project’s executor named to help further litigation for recovery of public funds spent on the work. “We also want copies of the pre-qualification proceedings of the tendering body, which has details of how the decision to contract the service provider was arrived at,” say the petitioners in their court papers. They are seeking to be provided with copies of the Hansard detailing deliberations for the expenditure of the project and how the county assembly approved it. PROJECT A HOAX In their papers filed before Justice Hellen Omondi last Friday under certificate of urgency, the petitioners claim the project was a hoax since it flopped a day after its launch on March 30. “The project, which cost close to Sh200 million, was a flop as there has never been any free or quick network services for the residents,” said lawyer John Githui. He told the judge that his clients had separately written to the county government requesting information on the deal in vain. “My clients were told that the project was undertaken by the State House digital team and some sponsors and that the county government had never provided any funds for it. However, there is no documented proof of this claim,” added Mr Githui. He told the court that the respondents were likely to tamper with some of the documents if the hearing was not fast-tracked. Judge Omondi directed the petitioners to serve the county government and the Attorney-General’s office with suit papers and set the matter for hearing on July 8. Speaking during the launch, Mr Dennis Itumbi, the Director of Digital Media and Diaspora Communication at State House said the free connectivity would simplify public participation in governance through the social media
