A jury last week awarded a couple from Las Cruces, New Mexico nearly $70 million in damages after finding that the husband had an unnecessary pacemaker implanted as a result of an alleged conspiracy between Biotronik—the pacemaker’s manufacturer, its salesman, Sowards’s doctor, and a local hospital to boost the device’s sales. The lawsuit alleged a “pay to play” scheme in which Biotronik funneled money to have its pacemakers implanted in people who didn’t need them.
