A new step has been made in the direction of creating our neighborhood quiet zone. A crossing will be put in at Few St. - the work is expected to be completed by October 30, 2013. BEFORE THE OFFICE OF THE COMMISSIONER OF RAILROADS STATE OF WISCONSIN In the Matter of the: Petition of the Wisconsin Department of Transportation for the Establishment of a Public Crossing of the Tracks Owned by the Union Pacific Railroad Co. and Operated by the Wisconsin & Southern Railroad Co. with Few Street in the City of Madison, Dane County 9170-RX-246 SUPPLEMENTAL ORDER On July 25, 2012, the Office of the Commissioner of Railroads (OCR) issued an order that approved the establishment of a public at-grade crossing of the tracks owned by the Union Pacific Railroad Co. (UP) and operated by the Wisconsin & Southern Railroad Co. (WSOR) with a multiuse pathway at S. Few Street (extended) in the City of Madison, Dane County by May 30, 2013. The decision referred to the pathway as the Central Park Pathway. On May 29, 2013, the WSOR requested a 90-day extension (August 30) to complete the crossing and signal work. In a June 7 email, the City stated it has no objection to the request, but did express its desire to have the crossing and signals installed by October 30, 2013. The railroad has not submitted a signal estimate to the Wisconsin Department of Transportation (DOT), although DOT requested the estimate in a letter dated September 6, 2012. Because this is a federal-aid project, the railroad and DOT must execute an agreement for funding of the signals before DOT can issue a ‘start’ notice. It should be noted that the state of Wisconsin does not use a lump sum payment method for signal projects, but instead reimburses the railroad for the actual cost of signal materials and installation. The lack of a signal estimate is holding up the project and therefore, the Commissioner takes the unusual step of setting a deadline for the railroad to submit an estimate to DOT. The WSOR shall submit the signal estimate to DOT no later than September 1, 2013. Because the Commissioner wanted to be sure that the Central Park project is actually being constructed before the crossing is installed, he included as a condition of approving the new crossing that the City notify the OCR when the bids for the park’s construction have been awarded and that no crossing installation be commenced until such time. The City has awarded the bid for Phase 1a of the Central Park project to Joe Daniels Construction.1 The OCR now publishes all notices, orders, proposed decisions and final decisions on the Internet. That the Wisconsin & Southern Railroad Co. shall install and maintain a crossing at-grade of Central Park Pathway with the tracks owned by the Union Pacific Railroad Co. and operated by the Wisconsin & Southern Railroad Co. in accordance with the design plans of the City of Madison in the City of Madison, Dane County by October 30, 2013. 1 https://cityofmadison/business/pw/contracts/docAndSpecs.cfm?ContractNumber=70082 2. That the Wisconsin & Southern Railroad Co. shall install and maintain 12” LED automatic flashing lights with other appropriate appurtenances, including two audible bells, in accordance with such plans as are filed with and approved by the Office of the Commissioner of Railroads at the crossing of tracks owned by the Union Pacific Railroad Co. and operated by the Wisconsin & Southern Railroad Co. with Central Park Pathway at-grade in the City of Madison, Dane County by October 30, 2013. 3. That the Wisconsin & Southern Railroad Co. shall submit the signal cost estimate to the Wisconsin Department of Transportation by September 1, 2013. 4. That the Wisconsin & Southern Railroad Co. shall clear brush and trees from its right-ofway for 330’ down the tracks in each direction from the Central Park Pathway crossing by October 30, 2013. 5. That the City of Madison shall clear brush and trees from its highway right-of-way for 330’ down the highway in each direction from the Central Park Pathway crossing by October 30, 2013. 6.
