A police officer attempted to use his authority to merge into my lane of travel from a parking lot. Of course I had the right of way and if he didnt try to be rude by trying to shove his vehicle in front of mine, I probably would have let him. No lights were flashing and no sirens were on. I gracefully went around his protruding vehicle and continued forward (on a one lane road). Of course he turns his lights on and pulls me over...I was ready, but was he? (You be the judge) Me: is there a problem officer? Officer: You could have just caused an accident. Let me see your license and registration! Me: So I could have caused an accident, by driving on the main road, with the right of way as YOU..were pulling out of a parking lot, attempting to over take my lane without having the right of way? Officer: You saw me attempting to merge in and didnt give me the opportunity to merge Me: (as Im gettting my registration and license) ..Exactly, I didnt give you the right of way to enter my lane of travel. So if there was an accident involving our vehicles, and you didnt have your lights flashing or sirens on..who would have been at fault in your opinion. I avoided an accident, but im definitely not the one who was about to cause one Officer: Im not going to argue with you Me: No, no..Im just trying to get further clarification, because it is my understanding according to the Massachusetts standards of fault #17 if you are Leaving or Exiting from a Parked Position, Parking Lot, Alley or Driveway and are in collision with another vehicle you are most likely 50% or more at fault for the accident and it is considered a surchargeable event..so again..was there a problem officer? Officer: glances at my paperwork and goes...You are all set Me: shook my head and smiled.... #HeWasntReady #Newbie
