A question came up today/tonight with a family member who lives in TN. The question is, does the TWRA (the VA equivalent of VGIF) have the right to search your boat without a warrant or probable cause? I know there are a few on here who spend a lot of time on the water in boats. What are your thoughts on this? Here is what I came up with: State law trumps federal law, except where Constitutional Rights are involved. The 4th amendment protects citizens from the invasion of privacy (regardless of what the NSA and Eric Holder says). This means that TWRA or VGIF, or any other state agency, has no authority to search your boat without probable cause or a warrant. This came up because of a conversation amongst relatives that assumed that TWRA, VGIF, USCG, or any other local, state or federal law enforcement had the right to trample our 4th amendment rights. Uniforms may be intimidating, but they are just cloth, and carry no authority other than what is given by "We The People." Please, leave your thoughts and opinions on this one. I hate to be wrong and would rather be corrected if I am, but I think that the 4th amendment trumps TWRA, VGIF and the USCG.
