A székely nép fennkölt menetelése nyomán Dr. Eva Maria Barki Bécsben élő nemzetközi jogász fontos petíciót juttatott el Románia vezetőihez, Traian Basescu államelnökhöz, Victor Ponta miniszterelnökhöz, valamint a román parlament két házához. Tekintettel a petíció jelentőségére sajtószolgálatunk csatoltan továbbítja azt, és alább közli az MVSZ által készített magyar, angol és francia nyelvű fordítását. Kérjük olvasóinkat, hogy juttassák el e dokumentumot minél több magyar és nem magyar címzetthez. PETÍCIÓ Őexcellenciája Traian Basescu, Románia elnökének Őexcellenciája Victor Ponta, Románia miniszterelnökének Románia parlamentjének: Képviselő házának és Szenátusának a bécsi Román Nagykövetség útján Már 2013. március 10-én is világszerte tüntetések és petíciók mutattak rá az erdélyi székelyek/magyarok még mindig szabályozatlan jogi helyzetére. A konfliktus megoldása helyett még jelenleg is az államigazgatási egységek megváltoztatása van napirenden, amellyel a több, mint 1000 éve ezen a területen őshonos székelyeket kisebbségi státusba kényszerítik, aminek célja egyértelműen az őket népként megillető jogok súlyos csorbítása és az önazonosságuk megőrzése elleni támadás. Ez sérti az alábbi nemzetközi jogi normákat: A Párizsi Békekonferencia Kisebbségvédelmi Szerződése a Szövetséges és Társult Főhatalmak és Románia között (1919. december 9.), amelynek megkötései az erdélyi románok 1918. december 1-i Gyulafehérvári Határozataiból következnek. Az Európai Biztonsági és Együttműködési Értekezlet Helsinki Záróokmánya Keretegyezmény a Nemzeti Kisebbségek Védelméről, különös tekintettel ennek 16. cikkelyére, amely kifejezetten az etnikai összetétel megváltoztatásától szóló tartózkodást tartalmazza. A Polgári és Politikai Jogok Nemzetközi Egyezségokmányának 1. cikkelye, a Gazdasági, Szociális és Kulturális Egyezségokmány 1. cikkelye (New York 1966. december 16.) Mindkét ENSZ Emberjogi Egyezmény 1. cikkelye a népek önrendelkezési jogát mint kötelező jogot – ius cogens tartalmazza (Aureliu Cristescu: The right to self-determination és sokan mások) A magyar eddig Európa legszerényebb népe volt, és nem csatlakozott a dél-tiroliak, katalánok, baszkok, flamandok és skótok önrendelkezési követeléseihez. De most úgy látszik, hogy véget ért a türelmük. A több száz éves hagyomány szerint meggyújtották az őrtüzeket, ami csak a létüket fenyegető végveszélyben szokott előfordulni. Ezt az egész régiót destabilizáló konfliktust csak a magyar/székely nép státuszáról szóló konkrét tárgyalások gyors felvételével lehet megelőzni. Bécs, 2013. 10. 27. On March 10, 2013, world-wide demonstrations and petitions pointed out the still unregulated legal status of the Székelys/Hungarians in Transylvania. Instead of resolving the conflict, the gerrymandering of administrative units is still currently on the agenda whereby the Székelys, indigenous in the region for more than a 1000 years are to be forced into a minority status, with the unequivocal objective of severe curtailment of their rights, which is in effect an attack on the preservation of their identity as a people. By dint of this, the following international conventions are violated: The Agreement of the Paris Peace Conference, of December 9, 1919 between the Allied Powers and Romania for the Protection of the Rights of the Minorities, the demands therein having originated in Resolutions of the Gyulafehérvár Assembly on December 1, 1918, by the Romanian residents of Transylvania. The Final Act of the Helsinki Accord for Security and Cooperation in Europe. The General Agreement for the Protection of National Minorities, in particular Article 16 thereof, which explicitly refers to the prohibition of the alteration of the ethnic composition. Article I of the International Agreement for Civil and Political Rights and Article I of the Agreement for Economical, Social, And Cultural Rights, New York 1966/12/16. Both of the two United Nations’ Human Rights Agreements, in their respective first Articles, include the right to self determination of peoples, as a mandatory right - ius cogens (Ref. Aureliu Cristescu: The Right to Self-determination). So far the Hungarians have been the most unassuming people in Europe, and they did not join the South-Tyroleans, Basques, Flemings and Scots in demanding the right for self-determination. However, it is now evident that they have come to their threshold of patience. According to their ancient traditions, hundreds of years old, they have lighted watch-fires, which they used to do only in grave emergencies. A conflict, destabilizing the whole region can only be prevented by the rapid commencement of concrete negotiations concerning the status of the Hungarian/Székely peoples. Au lieu de résoudre le conflit, il est toujours à l’ordre du jour la modification des circonscriptions administratives laquelle restreint en minorité les autochtones székelys habitant cette région depuis plus de 1000 ans, et cela signifie clairement que l’objectif est la réduction importante de leurs droits en tant que peuple et une atteinte contre la préservation de leurs identités. Cela viole les normes internationales suivantes : La Convention du Traité de la Minorité de la Conférence de Paix de Paris entre les Puissances Alliées et Associées, et la Roumanie (le 9 décembre 1919) dans laquelle été comprise par déduction les revendications des roumains de Transylvanie, la résolution Alba Iulia du 1er décembre LActe Final dHelsinki sur la Sécurité et la Coopération de la Conférence Européen Convention-cadre sur la Protection des Minorités Nationales en particulier eu égard à l’article N°16 qui exclue catégoriquement la modification de la composition ethnique. La Convention International Relatif aux Droits Civils et Politiques article 1, et le Pacte Économique, Sociale et Culturelle article 1 New York (le 16 décembre 1966) Les premiers articles des deux Pactes des Droits de l’Homme ci-dessus des Nations Unies, comprennent lautodétermination des peuples comme loi contraignante - ius cogens (Aureliu Cristescu : The right to self- determination) Jusqu’à présent les Hongrois étaient le peuple le plus modeste en Europe, et ils ne se sont pas joint aux revendications concernant lautodétermination des tyroliens du Sud, des catalans, des basques, des flamands et des écossais. Mais maintenant, il semble qu’ils ont franchi la limite de leurs patiences. Selon la tradition séculaire ils ont allumé le feu de bivouac, ce qu’ils ne font qu’en cas de grave danger. . Ce conflit déstabilisant toute la région ne peut être évité que par les négociations rapides et spécifique du statut pour la population hongroise/székelys de Transylvanie.
