AES ATTEMPTS BAND AID ON THEIR BAD ZONING INITIATIVE Without any fanfare or blathering praise from Aspel, AES quietly resubmitted their initiative in an attempt to band aid flaws in the zoning highlighted by BBR at last weeks public meeting. Amongst other elements, BBR highlighted that the AES Initiative takes power away from the Council. The examples BBR used were a clause that did not let the council make any zoning changes until 2025; and that for example the initiative took away the authority of the Council to disapprove drive restaurants or set the hours for live entertainment at restaurants. So AES changed these two specific items. But their fixes are just bandaids on a gaping wound. AES now allows one chance for the Council to change their zoning, but they make it so onerous that any substantative change cannot happen. To change the zoning before 2025 the Council must approve a change with a 4/5 vote, the change must also be approved by the land owner (AES) and the change cannot lower their density caps. (see attached photo of this section of the initiative). The second change changed large restaurants from a permitted use to a conditional use, which does give the Council back its power to control this one use. But they did not touch any of the others. The attached table compares harbor zoning conditional uses to the AES initiative. This initiative was cooked up by AES for AES in a back room and was then coordinated with Aspel and City staff prior to roll out with ZERO public input. So it should be no surprise that it is one-sided zoning and bad for Redondo.
