ALL THE GOR BANJARA FOR AP/MAHARHSTRA/RAJASTHAN/U.P/TAMIL NADU/KARNATAKA /GUJARAT /HIMACHAL PRADESH/MADHYPRADESH/CHATIISGARH/UTTARKHAND/DELHI /HARYANA/PUNJAB /ORISSA ETC To The Ministry of Finance Economic Affairs Division New Delhi RIGHT OF EQUALITY OPPORUNITY IN PUBLIC EMPLOYMENT – BANKING SECTOR /PSU/PSE/STATE GOVT/CENTRALGOVT Sir, It is bring to your kind notice that reservation policy has adopted in India since from the inception dated 1955 however it has introduced between 1980 to 1990 which was below the par as per standard requirement where the SC/ST downtrodden employee has got lack of opportunity to rendered their service in Government Organisation despite they are having 22.5% reservation in central level as per available records. As per establishment of India, reservation is governed by constitutional laws, statutory laws, and local rules and regulations SC/ST/OBC are the primary beneficiaries of the reservation policies under the Constitution – with the object of ensuring a level playing field. But, there is a drastic gap amongst upper and lower caste for which General class are enjoying full benefits for occupying the topmost premiere jobs in Government Organisation sectors wherein backward /oppressed class are still behind them in every segment of field .The entire administration are under the control of upper class people those who have been thrashed the lower caste folks in waste bin and allotted the seat exclusively for them as they have already set aside in former jobs for education and in every respective field. To achieve their goal and maintaining former philosophy they have bind the system and criticised that for governing the Banking system wherein they have implemented the system that merit should be required for qualifying the promotion in order to prevent the oppressed class people easily and encouraging vote bank politics for regulating the entire banking on the upper hand people.The most important point is that in India scheduled castes (SCs) are groups with low social and ritual standing, while scheduled tribes (STs) are those distinguished by their tribal culture and physical isolation. Both groups have been excluded from opportunities and rights, which has prevented them from improving their socioeconomic status in Indian society. In order to combat the historical discrimination against such groups, various affirmative action policies have been enacted in the Indian constitution. Among these policies is mandated representation for SCs and STs in the state legislative assemblies – each state must set aside a certain share of the seats in its legislative assembly that can only be held by SCs and STs members, with this share equal to the SC and ST share of the state population in the last preceding decennial census. To get preferential treatment for disadvantaged minority groups one have to take affirmative action against these irrational policies for which minority groups are facing acute problem and daunting task for touching to higher scale. It is evident that the criteria set up in the banking organisation is not suitable to SC/ST incumbent for promoting to scale –III to IV and above. Since the management has intentionally adopted the policy for merit channel in order to restrict the downtrodden/oppressed employee as per extant guidelines resolution passed by departmental of financial service dated vide letter F. No.4/11/1/ 2011 – IR dated 05.12.2011 to meet their requirement . In general course, it is observed that the competent authority is belong to Upper caste category such as Brahmins etc for which they are exercising the delegation of power to give credential of APR /ACR therefore it is difficult to get the maximum marks while the concerned officer is well talented in the respective field .To maintain the transparency and accuracy seniority channel is mandatory at least to reach their destination and to occupy the higher grade scale for oppressed class employee. As per survey you can identified that in the Middle management and senior management level hardly the oppressed class employee has reached their level in rare exceptional case. Therefore, our contention is that the higher post occupied by the competent authority does not allow maximum marks to oppressed class due to reservation and caste origin issue. Keeping in view of the above positioned explained in the representation you may understand the reality and actual fact figure from various PSU bank .On the other hand , in the interim ,you may adopt the policy in due course that Appellant authority should be SC/ST Officers obligatory in order to review the ACR/APR for all the public sector Banks though he is not available in the same jurisdiction or centre but we may allow them from any centre so that they can assess the strength of the concerned officer for whom the injustice has occurred and he shall empowered the delegation without any hindrance from the appropriate authority. It is to be noted that as the recent order in Rajysabha for the equality of opportunity in the matter of public employment has added the further amendment in the constitution of India as per article 16 for the clause 4A dated 3.5.2012 which will be implied on retrospective affect 17.6.1995 but it remain silent till the date. Thus to convey the actual policy the Supreme Court had been uphold the decisions of High Courts from respective States like Uttar Pradesh and Rajasthan which is not appreciable and mislay the representation put forward by the petitioners demanding that the concerned State will have to show in each case the existence of the compelling reasons, namely, backwardness, inadequacy of representation and overall administrative efficiency before making provision for reservation in promotion. As the Ministries of the Government are fully aware for the above episode and instructions have been issued from time to time regarding the principles to be observed in and the method of determining seniority followed as per their policy which is not favourable to downtrodden category resultantly the prospects of promotion of the employees belonging to the Scheduled Castes and the Scheduled Tribes are being adversely affected. So I humbly request you to intervene in the matter and review the case as it is genuine to the backward class employee those who are striving hard to reach the upper scale in the banking industry.
