Section 3 allows legalization to the current illegal population within 6 months of enactment, allowing illegal immigrants to become registered provisional immigrants (RPIs) as soon as the Secretary of Homeland Security submits a plan to secure the border. 2. Sections 1111 and 1112 invite the Department of Justice’s controversial, politicized Civil Rights Division to second-guess law enforcement decisions by border patrol and other agents. This bill empowers the Civil Rights Division to meddle in Department of Homeland Security’s (“DHS”) use of force policies and creates mandatory cultural sensitivity and ecological impact training for immigration enforcement agents. These provisions potentially demean Border Patrol agents. Furthermore, these provisions hinder agents’ ability to defend themselves and secure the border against dangerous human smugglers, and smuggling scouts, drug mules, and violent cartel members. 3. Section 2101 of the Gang of 8 bill interacts with Obamacare to create de facto affirmative action for illegal immigrants. Under this bill, RPI immigrants will be eligible to work, but will not be eligible for the Obamacare subsidies (and, incidentally, will not be required to buy insurance like the rest of us). Under Obamacare, employers are required to pay a $2000 penalty for most employees that receive a healthcare exchange subsidy. An RPI employee will never trigger the $2000 penalty on the company. Under section 2101, illegal aliens are immediately able to work in the U.S. and travel outside the country when they simply apply for legalization (even if they are ultimately denied). 5.The Corker-Hoeven “border security” amendment does not require any additional border security before legalization. And there is no requirement that the border actually be completely secured. To put that in context, Secretary Napolitano stated on February 4, 2013 in San Diego, California: “I believe the border is secure. I believe the border’s a safe border. 6. The Corker-Hoeven amendment doesn’t require a secure border. The additional “border security” assets required by this amendment just have to be in place 10 years in the future before illegal immigrants can obtain green cards, and eventually citizenship. Even then, the amendment doesn’t require a biometric entry-exit system—just an outdated biographic system that can’t track people nearly as well. And it doesn’t require an entry-exit system at land ports. 7. Section 2101 waives several barriers to admission for illegal immigrants (including public charges, people who have ignored a notice to appear to answer deportation charges, people who have been deported in the past, and those who have committed document fraud). But it doesn’t grant these waivers for legal immigrants. (pg. 947-48) 8.
