ANG ANUMANG RECORDED MESSAGE NA NAKUHA DITO AY HINDI TINATANGGAP NG KORTE BILANG EBIDENSIYA. ANG PAG-RECORD NG USAPAN SA TELEPONO O VIDEO CONFERENCE O INTERNET PHONE NG WALANG CONSENT O PAGPAYAG AY ISANG KRIMEN NA PINAPARUSAHAN NG KULONG UNDER REPUBLIC ACT NO. 4200 KNOWN AS ANTI-WIRETAPPING LAW. May nagtanong sa E-Lawyers Online kung pwede daw ba niyang i-record ang usapan nila sa telepono o internet phone at pag-amin o pag-admit ng kabit ng kanyang mister bilang ebidensiya. Ganito ang tanong niya: "Gud pm attorney, nag-uusap kami ng mister ko at ng kabit niya sa celphone para pag-usapan ang aming relasyon at ilang beses na nilang inamin sa akin ang relasyon nila. Galit ako sa kanila kaya gusto ko sana na i-record ang usapan namin at gawin itong ebidensiya laban sa kanila. Tama po ba ang gagawin ko?" Ang pakikipag-usap sa telepono, video conference o internet phone ay isang pribadong komunikasyon at ito ay protektado ng batas. Ang privacy of communication o pribadong pakikipagkomunikasyon ay isa sa mga mahalagang karapatan na pinoprotektahan ng ating 1987 Constitution at hindi ito pwedeng labagin except kung may utos ang korte o para sa seguridad at pag-iingat ng publiko. Kung kaya sinasabi sa ating Saligang Batas na anumang usapan na nakuha ng walang pahintulot ng mga taong naguusap ay hindi pwedeng gamitin bilang ebidensiya sa korte laban sa kanila. Ito ay nasa Section 3, Article III ng 1987 Constitution: "Section 3. The privacy of communication and correspondence shall be inviolable except upon lawful order of the court, or when public safety or order requires otherwise, as prescribed by law. Any evidence obtained in violation of this or the preceding section shall be inadmissible for any purpose in any proceeding." Kung kaya ang pakikipag-usap sa telepono, video conference o internet phone ay hindi pwedeng i-record ng sinuman na walang consent o pahintulot ng mga taong involved dito. Ang pagrerecord ng pakikipag-usap sa telepono, video conference o internet phone na walang consent o pahintulot ng mga taong involved dito ay isang krimen at pinaparusahan ng kulong na 6 months-6 years under Republic Act No. 4200 otherwise known as "The Anti-Wiretapping Law".
