ARTICLES PUBLISHED IN (2013) 7 SCC PART 2 – AUGUST 14, 2013 Harmonising Liberty And Security In Social Order - Legal Mechanism for Harmonising Liberty and Security in Social Order: A Critical Study of the safeguards provided in the Constitution and Criminal Jurisprudence in India by Devendra Kumar Arora, (2013) 7 SCC J-6: In every civilised democratic country, liberty is considered to be the most precious human right of every person. Liberty is the most precious of all the human rights. Personal liberty is of non-negotiable value. It is inalienable fundamental right, which cannot be abridged or curtailed, except according to the procedure established by law. A just, fair and effective administration of criminal justice is the cornerstone of a society and an essential component of public confidence in the institutions of a Government. In other words, there can be no liberty without social restraint. If the Constitution is a chariot then the four components of the criminal justice system viz. the police, Bar, judiciary and correctional services are its horses. Harmonious efforts of all these four agencies are essential for moving the Constitution towards its goal of establishing a just society in India.
