Agency- The relationship that exists between two person when one, called the Agent, is considered in law to represent the other, called the Principle, in such a way as to be able to affect the principals legal position, in respect of strangers to the relationship, by the making of contracts and the depositions of property. Agency is a consensual and fiduciary relationship between two parties. See Burton v. Regina city policemans association , local 155,[1945] 2 W.W.R. 273. Agent-One who, by mutual consent, acts for the benefit of another, one authorized by a party to act on the partys behalf. Principle- Most important; primary;highest rank, authority, character, degree or importance. In the law of agencies, one who has permitted or directed another to act for his benefit and subject to his direction or control. W.Seavey, Law of Agency s.3 (1964). Master is a species of principle. Id. In a transaction conducted by an agent, the principle is DISCLOSED if the party has notice of his identity; he is Partially Disclosed if the other party has notice of his existence but not his identity; he is UNDISCLOSED if the other party has no notice that the Agent is acting for the principal Id at s.4. Canadian Law Dictionary 4th edition. Apprehend-To arrest or seize a person; apprehension means the seizure or taking hold of a man....It means the taking hold of him and detaining him with a view to his ultimate surrender.R. v. Commercial Brokerage Co. Ltd.[1922] 3 W.W.R.508 (Alta.S.C). Strangers are the children in this relationship, with no rights, but only looked at as a commodity. Same thing happens when an individual goes to court or is sentence, they have no rights, Just someone to make money out of. You must of notice the word PERSONS this applies to a Artificial Person not Natural. There are only two types of Persons. But an Indian is not a person under the law, An Indian is classified as a signatory Indian.
