President Jimmy Carter A federal appeals court in New York on Wednesday ruled that the government could enforce the NDAA law that authorizes the US military to secretly indefinitely detain without trial anyone whom the Government suspects of supporting terrorists-including journalists that interview them & publish their views, activists who support their cause, sympathize with their grievances or protest their treatment & those who criticize the Government or whistle-blowers who reveal crimes by the Government. Anything related to the War on Terror that is construed by the Government as hostile to the War on Terror or as offering support to individuals or groups that the Government considers terrorists allows the US Government to secretly hold such persons indefinitely without trial as enemy combatants. The Appeals Court reversed federal district judge Katherine B. Forrest’s decision last year to permanently block the law, part of the National Defense Authorization Act of 2012 as unconstitutional. This decision by the Appeals Court was very clever. Instead of addressing the merits of the case, protecting the rights of the American people & upholding the US Constitution the Court simply stated that the plaintiffs lacked "standing." Since they had not yet been detained under the law nor could they show that the Government planned to imprison them-the Court reasoned-they had not been injured or affected by the law. Since no one who is currently being secretly detained is a plaintiff & the plaintiffs are not yet detained-the NDAA law stands & the Government can enforce it. And we have a Constitutional Republic?
