Bruck, Defense attorney Timpothy G Watkins Dzhokhar Tsaranev could not have placed a black backpack containing a weapon of mass destruction because it is an established fact that he only had a white backpack with him. 1. Dzhokhar Tsaranev carried a white backpack to the 2013 Boston Marathon. 2. The Joint Task Force determined and announced that the Second Bomb was contained in a black backpack. A photo of the tattered remains of this backpack also exists and is known to the public. 3. The National Geographic re-enactment of the Boston Bombing is innaccuate. It shows Dzhokhar with a dark gray backpack -- and should not be confused with the actual video taken by the security camera at Lord and Taylor, which video has not been released to the public and has only been described in the news by persons who were briefed on the videos contents rather than shown the video. None of these briefings discussingthe video of Dzhokhar putting down his backpack have ever mentioned the color of the bag placed in the video. 4. It has been stated in an by the Governor of Massachusetts, Deval Patrick, in an eary news conference that Dzhokhar made a phone call at the location where he placed his backpack. I submit that it is reasonable to assume that Dzhokhar put down his backpack in order to remove his phone from the backpack, since no phone can be seen in any of the many pictures of Dzhokhar taken before the Second Bomb explosion. I hope defense will find some use for this evidence in the defense of Dzhokhar Tsarnaev whom I believe to be innocent of placing the bomb and of all charges involving the use of a weapon of mass destruction.
