Honble Sir, I want to bring to your kind notice that the below mentioned five Govt. Schools with a strength of 1000 Students all from poor families falls under my Azampura Municipal Division. The below mentioned five Govt Schools are on nearly 4000 Sq Yards worth property of Rs/ 20.0 Crores. 1) Govt. City Model Primary School (English Medium) 2) Govt. City Model High School (English Medium) 3) Govt. Girls Primary School, Kattalguda (Old) (Telugu Medium) 4) Govt. Gils High School, Chaderghat (Old) (Telugu Medium) 5) Govt. Primary School Amara Jeevi Potti Sriramulu (AJPS) Telugu Medium) During the month of Nov 2012 when I came to know about the shifting of the above said Schools and handing over the premises to Hyderabad Metro Rail Ltd (HMR) for construction of a Metro Train Station from the local residents and the parents of the children’s, I approached the Andhra Pradesh State Human Rights Commission vide HRC No: 2957 of 2012 praying not to vacate or demolish the Schools from the said Building at Chaderghat as the Children’s education will be hampered in the middle of the academic year. Honble Chairperson APSHRC while allowing the case directed the Dist. Collector Hyderabad to file compliance report within three days. Accordingly the Dist. Collector has filed his report vide letter No: E5/4033/2007 dated: 4th Dec 2012 in which the Collector Hyderabad has assured the APSHRC by contending that no instructions had been given to Tahsildar Charminar or Dist. Education Officer, Hyderabad for vacating or demolition of the above said Schools. Hence the Honble Commission has taken the report of the Dist. Collector, Hyderabad on file and assured me that no injustice will be meted out to the poor School Children’s right in this middle of academic year and the case was closed furnishing a copy to me. But again on 5th Nov 2013, I received fresh complaints from the local residents and the parents of the School Children’s that since one week some unauthorized persons have trespassed into the premises of the above said five Govt. Schools at Chaderghat which are located in one building, have been totally razed and nearly 50 Trees have been axed and are being burnt in the premises causing air pollution in surrounding locality. They had even taken total infrastructure i.e. School benches, Chair, Tables, Almiras, Computers etc belonging to 5 schools. The expenditure of the 5 Schools was mobilized by like minded social activists who came forwarded along with me to donate the amount required every year. The constitution of India has provided the compulsory education for children’s as a fundamental right besides Right to Education Act (RTE), but in reality in children have been put to untold agony by forcibly shifting 1000 School Children’s in the middle of the academic year violating the RTE Act and also the fundamental right to Education under the Constitution of India. The above Act of demolishing the building and shifting of children’s is nothing but the betrayal of assurance given by Dist. Collector Hyderabad to the Honble Andhra Pradesh Human Rights Commission. Being the local Corporator (Public representative) it is my duty to protect the Fundamental Rights of the Children and to safe guard their Education under RTE Act. On this issue I had complaint to the Inspector of Police, Chaderghat on 5th Nov 2013 and to The Tahsildar, Charminar Mandal on 6th Nov 2013 but no action has been taken by them to stop demolition or vacation of the said Five Govt. Schools situated at Chaderghat. It has come to my notice that there has been lot of corruption in the Education Department in which 4000 Sq Yard of land worth 20.0 Crores had been given to Hyderabad Metro Rail Limited. From the Principals of the Govt. Schools to the Dist. Education Officer, Hyderabad have all been bribed to vacate the said Building and many high profile politicians are also involved in this scam. After the demolition of the Schools Buildings 1000 students carrier had been on road. Depriving a student from Education is a violation of Fundamental Rights under Indian Constitution and Right to Education (RTE),there has been a violation of WALTA Act in felling, cutting and burning of Trees for which no action had been taken by any concerned authorities. Hence appropriate action may be taken on top priority and a copy of which may be transmitted to me in the interest of justice. Hence it is prayed to the Honble Commission: 1) To Direct the Dist. Collector, Hyderabad, Commissioner & Director, School Education Govt of A.P,Dist. Educational Officer, Hyderabad Tahsildar, Charminar Mandal,Hyderabad not to vacate or demolish the existing School Building until the completion of this academic Year. 2) To Direct the Managing Director, Hyderabad Metro Rail Limited not to take up further constructions of Metro Rail Station or Pillars in the School Building premises until the Completion of this academic year. 3) To Direct the Commissioner of Police, Hyderabad, Deputy Commissioner of Police (East Zone),Asst. Commissioner of Police, Sultan Bazar and Inspector of Police Chaderghat that no force is used on the Children’s by any agencies or private persons to vacate the five Schools situated in the said Building at Chaderghat and to take a legal action against the officials of Education Department over the theft of School Infrastructure and also a legal action may be taken against the Hyderabad Metro Rail Ltd officials for demolition of the said School Building with cutting/felling/burning of Trees under WALTA Act and other necessary acts as deemed fit. 4) An explanation may be called from the Dist. Collector, Hyderabad and Dist Educational officer, Hyderabad as to why the assurance given to Honble Commission was not maintained. 5) A through inquiry with Vigilance and Enforcement Dept, Govt of Andhra Pradesh and Anti Corruption Department, Govt of Andhra Pradesh may be ordered to file a report about how come so much precious land worth 20.0 crores was handed over without any compensation to the Education Department by the Dist.
