An Expatriate intending to work in Indonesia must posses the proper visa (working visa). The validity of this visa is vary from 1 to 12 months. It will be depend on company’s need. The expatriate can be granted this visa only upon approval from Directorate General of Immigration Jakarta. For obtaining this visa, the expat must have a sponsor in Indonesia. And the sponsor must be a registered company or foundation in Indonesia. There are 4 types of working visa : 1-6 months (temporary working permit) 7-12 months (yearly working permit) 2 years (only for specific job title) or KITAP The general requirements for applying a working visa from expat are : Copy passport with minimum validity is 18 months Copy CV Copy of highest education certificate Copy of any insurance participation certificate/card Red background photo The general requirements for applying a working visa from sponsor are : Article of association Approval Letter from Investment Coordinating Board/BKPM (IUT) for Foreign Investment or SIUP for Local Investment or any license from other government agencies/ministry Tax Payer Number (NPWP) Domicile Certificate (Surat Keterangan Domisili) from sub-district office/Kelurahan Approval Letter from Ministry of Law & Human Rights TDP Wajib Lapor Ketenagakerjaan (UU No. 7 Tahun 1981) Organization Chart Identity card of Indonesian staff as expat’s counterpart (TKI Pendamping) Procedures of obtaining working visa are : Approval of RPTKA (Foreign Manpower Utilization Planning) As this visa is made for working purpose, so the sponsor is required to ask the approval of job titles which will be used by the expat employed by the sponsor from Ministry of Manpower and Transmigration (MMT). And this approval is called as RPTKA. RPTKA will be valid only for 6 months (for temporary) or 1 year (for yearly KITAS) but for the job title of “Director”, it should be valid for 2 years. This RPTKA can be renewed if the sponsor still needs the expat’s expertise. TA01 (Recommendation Letter for obtaining working visa) The expat must posses a recommendation from Ministry of Manpower and Transmigration prior to obtaining a working visa approval from Directorate General of Immigration Jakarta. And this recommendation letter is called as TA01. TA01 is made only for the working expat. But for the expat’s family, it is not required. This recommendation can applied only after RPTKA is completely done. And the sponsor will not receive this document in original because it will be used to proceed the working visa. TA01 is valid for 2 months. VTT/Visa Tinggal Terbatas or Telex (Limited Stay Visa) After Directorate General of Immigration (DirGen of Immigration) received the original TA01 from MMT then the sponsor can apply for VTT at DirGen of Immigration Jakarta. DirGen of Immigration is only issuing an approval letter (VTT) but the visa sticker must be collected at Indonesian Embassy outside Indonesia after VTT is issued and sent to Indonesian Embassy. So, in this step, the sponsor/expat must provide the information of which Indonesian Embassy that will be visited by the expat to collect this visa. This VTT must be collected within 60 days since its issuance date and after the visa is collected from Indonesian Embassy, the expat must enter Indonesia within 90 days since its issuance date from Indonesian Embassy. In case the expat can’t come until the 90th day is exceeding, the sponsor must start the process from TA01. If the expat brings his family to join him staying in Indonesia then his family’s staying permit procedures will be started from this step. IMTA (Work Permit) For the sponsor who is employing the expat, must possess this document to work legally in Indonesia. For obtaining this permit, the sponsor must pay the compensation of employing expatriate in Indonesia to MMT which amount USD 100/month. This fund is called as DPKK. This fund must be paid full in advance. The total amount should be counted referring to work period which stated in TA01. For example, the sponsor would hire an expat for 12 months, so you need to pay fully USD 1,200 to MMT’s account. We always suggest our client to arrange this payment soon after the VTT is issued by DirGen of Immigration. The purpose of this suggestion is to prevent any inspection from Indonesian ministries/government agencies that might caught the expat who are already start working while the IMTA is not issued yet. KITAS/Kartu Izin Tinggal Terbatas (Limited Stay Permit) After the expat with/without his family collecting his visa at Indonesian Embassy, he can enter Indonesia and within 7 days of arrival, he is required to report his arrival and start the KITAS processing soon. In case the expat are failed to report the arrival to Immigration Office, he must be charged for penalty fee which amount IDR 200.000/day. In this step, the expat must come to immigration office to be taken his full finger print and photo. KITAS must be kept safely and the expat must prevent any broken/damage or losing this card. Exit Re-Entry Permit For the expat who hold yearly KITAS, they will be allowed to hold exit re-entry permit. But for temporary KITAS holder, they are not allowed for having this permit. There are 4 types of exit re-entry permit : 3 months (single exit re-entry permit) 6 months (multiple exit re-entry permit), renewable 12 months (multiple exit re-entry permit) 24 months (multiple exit re-entry permit, only for 2 years KITAS holder/KITAP) Expat is not obligated to process this permit if he will not exit and re-enter Indonesia territory within holding KITAS in Indonesia. But if he must exit and re-enter Indonesia several times within holding KITAS, then he must consider to ask multiple permit. This permit can be obtained not only for working expat but also his family. SKLD/Surat Keterangan Lapor Diri (Certificate of Police Registration) This permit is issued by Police Headquarter Office. The KITAS holder must have this document and must process this document within 30 days after KITAS issuance date. If the expat is failed to process this document, then he will be jailed or pay some amount as the penalty fee. This permit also must be proceeded for expat’s family. STM/Surat Tanda Melapor (Report Certificate) This permit is issued by Resort Police Office/Provincial Police Office nearest to expat’s home address. This permit is becoming the report to the police office that there is expat living in their region. This permit also must be proceeded for expat’s family. SKTT/Surat Keterangan Tempat Tinggal, SKSKP/Surat Keterangan Susunan Keluarga Pendatang & Formulir Isian Biodata Pendatang WNA This permit is issued by Population and Civil Registration Agency. Expat who is already obtained KITAS, must report his domicile to the population and civil registration agency within 10 since KITAS issuance date. This permit also must be proceeded for expat’s family. Laporan Keberadaan (Report Certificate) Laporan Keberadaan is a report to local Manpower and Transmigration Agency (Dinas Tenaga Kerja dan Transmigrasi). The sponsor employing expat must report its expat to local Manpower and Transmigration Agency.
