Angling Pirates fall prey to the newly promoted section to the Fisheries Act 2003. Gone are the days when you can turn up on a fishery and intentionally not obtain permission, permit or other. Previously enforcement was the trade of the E/A Bailiff, the local Bailiff Powers being limited. As such the Police had little interest professionally speaking as not being within remit. Fisheries Act 2003 section 116-11 was indeed put to test last week-end and without question received a swift and correct response from the Police. In that the Act under 116-11 relates to theft under the heading of “Theft of Fishing Permission”. Simple heading that qualifies as theft as in the meaning of the Theft Act. Thus the Police do now have something to hang a hat on. Last week-end 8th to 10th August four individuals from Liverpool drove a horse and cart through E/A and our rule book. As a last resort, having had no less than five contacts with this group not including Roger Carswell and Dale Dulson evident difficulties. Friday 8th 11pm arrival Sydney Avenue tent up and fishing by 11:30 I informed them of the rule book and requested they leave 00:30 Saturday still fishing away. 116-11 call made and a removal was completed before 1:00 am. Saturday and Sunday was the turn of Monkmoor for this crew, by Sunday afternoon enough was enough. 3 pm a second call regard to 116-11 being made with a plan of execution, a final visit “leave the area and don’t return” or the pre-planned assistance will avail. Seemingly a perfect spanner, in the Bailiffs toolbox.
