Aron Pesa Shayo, who is being represented by Kiharu MP, Hon Irungu Kangata, as his lawyer filed a criminal case against Raila Odinga at Kibera Law Courts seeking to prosecute him over hate speech during CORD rallies. He claims Railas statements were alarming, likely to cause fear and alarm among the public. The utterances are punishable under Sections 66,77 and 132 of the Penal Code, Cap 63 of the Laws of Kenya. The case was filed under certificate of urgency and the plaintiff was directed to serve Raila and the Director of Public Prosecution (DPP), Keriako Tobiko with court summons. The senior resident Magistrate Brian Khaemba ordered Shayo to serve Raila and Tobiko with a hearing notice. The case is scheduled for hearing on July 29th.
