Attorney: Judge wrongfully tossed Assemblyman Carmelo Garcia’s lawsuit against Hoboken HOBOKEN — A judge tossed one of Assemblyman Carmelo Garcia’s politically-charged lawsuits against Hoboken, and now attorneys for the city housing authority are targeting the second. The surviving complaint—filed in October, after Garcia was fired as executive director of the city housing authority—wrongfully re-litigates the claims already dismissed, a letter from Thomas Abbate, an attorney for the housing authority, claims. Abbate states that Garcia’s wrongful termination lawsuit tries to revive claims made under the “whistleblower” act, which had been dismissed from the first lawsuit in March. The lawsuits allege that Mayor Dawn Zimmer and other city authorities schemed to push Garcia out of the housing authority because he didn’t support their politics. In the most recent complaint, Garcia alleges that Zimmer “sought to transform Hoboken into a white community” and that he was fired, in part, because he’s Hispanic. Abbate’s letter asks Garcia to withdraw the second lawsuit, which he calls “a cheap publicity stunt.” Hudson County Superior Court Judge Christine Vanek dismissed Garcia’s first lawsuit on Dec. 19, citing his attorney’s failure to meet requests for discovery in the case. Garcia’s attorney, Louis Zayas, said he will be filing a motion on Friday to have the first lawsuit reinstated.
