Fortun, is it possible for the Ombudswoman to offer a plea bargain of lesser offense with the condition that all her PDAF & Malampaya sourced wealth be forfeited and that she spill the beans on all accomplices? ARF:@Marc Cain,- I love questions like these. Pinapa-isip nyo ako. Also, nakakakuha ng tip Ang mga law students hahaha! The Ombudsman has NO power to enter into compromise agreements. Her job under the law is to investigate and, when proper, file the criminal information in court. Can Napoles, Gigi Reyes etc. enter into a deal with the prosecutors later when the case is before the Sandiganbayan? YES. They can plead to the lesser offense of Corruption of Public Officials, on condition that she will reveal everything (hindi lang mga accused but ALL who benefited from her operations) and testify to what she places in her affidavit. She will plead guilty to the lesser offense, and will have a shorter prison term.
