August 4, 2012 Larry Morse District Attorney Merced County District Attorney’s Office 550 West Main Street Merced, CA 95340 Dear Mr. Morse, Over the past couple of years, Merced County Sheriff’s Department Commander James Buttrey did unlawfully, willfully, maliciously, and repeatedly follow and harass Sheriff’s Department employee Kathy Mathis, and did make credible and overt threats to place that person in reasonable fear for her safety and the safety of her family in violation of Penal Code Section 646.9(a), Stalking-Felony. Buttrey’s actions were, and remain, more than a breach of ethics, Merced County Sheriff’s Department Codes of Conduct and By-Laws, and applicable labor and civil rights laws. They constitute a serious and ongoing threat to the community considering the Defendant’s (as he should be called, if there was Equal Justice in Merced) predatory pattern of behavior, the fact that he carries loaded guns with the skill and resolve to use them, his and his employer’s total lack of contrition and responsibility, and plenty more that would alarm anyone—and certainly those, like yourself, entrusted to protect our public’s safety. Further, the Defendant’s conduct has brought NO disciplinary action by his supervisors at the Merced County Sheriff’s Department, thus giving the Defendant the dubious license to continue this pattern of extreme criminality. This latter fact is witnessed by the Defendant’s continued employment by the Merced County Sheriff’s Department without being placed on administrative leave, loss of income, demotion of rank, or any other appropriate penalty for someone who clearly goes beyond, as you trenchantly put it in a recent persecution, “beyond the parameters of common sense.” (A matter of public record) Thus, the Defendant poses a credible threat to Kathy Mathis and other vulnerable members of our community. In sum, I, on behalf of the citizens of the great and just County of Merced, ask the District Attorney and his office to prosecute this case with zeal—much in accord with recent precedent. We need to put this “bizarre,” “irrational,” and wicked offender under the wraps of a TWENTY MILLION DOLLARS bail, long-term incarceration, and public spectacle and ridicule. Thus far this criminal (that would be Buttrey, yet his accomplice Sheriff Pazin merits attention as well) has caused, among other predictable and proximate consequences, the victims to be exiled to protecting Mickey Mouse at Disneyland!!
